AGENDA ITEM 11.- REQUEST FOR EXTENSION ON PRELIMINARY PLAT-FRANK'S
PLACE
BACKGROUND/CONSIDERATION: I have enclosed a request from Jean
Johnson (February 20, 1997 letter) to extend the Preliminary Plat
approval for Frank's Place Subdivision. I have also enclosed a
recommendation from the planning staff to approve the extension.
RECOMMENDATION: I concur with Narda Wilson's recommendation to
extend the plat for one year to allow the new developer some time
to complete the improvements.
ACTION REQUIRED: A MOTION will be needed to grant the extension for
this preliminary plat.

Dear Clarence
Stokes and Associates have requested an extension of preliminary plat approval for
Frank's Place Subdivision by way of a letter to your office dated February 20, 1997
which is attached. Preliminary plat approval was initially granted on September 6,
1994 for one year under the previous subdivision regulations and then granted a two
year extension for a total of three years. Frank's Place is a nine lot residential
subdivision in an RA-1 zoning district which is located in southwest Kalispell and as
shown on the attached vicinity maps.
Under the current Kalispell Subdivision Regulations, preliminary plat is routinely
granted for a period of three years with a one year extension upon request, for a total
of four years. The applicants are requesting another one year extension to avoid the
necessity of going through the preliminary plat process again.

On April 3, 1996 the City Council approved a two year preliminary plat extension for the
above mentioned subdivision. The preliminary plat was originally approved for one year
accounting for the normal three year approval.
Due to the conditions the City Council imposed on the subdivision the project was
rendered economically marginal. However, the developer has entered into negotiations to
sell the project to another developer that has intentions to proceed. A condition of the
sale will be obtaining a one year extension for the preliminary plat. The additional year
would afford him the ability to complete the improvements in a timely manner.
I have enclosed copies of the pertinent correspondence to provide you with a
chronological of events since inspection.

Dear Mr. Johnson,
On Monday April 1, 1996, the City Council approved the extension
requests for Sunrise View and Frank's Place preliminary plats.
The extensions are retroactive, with Sunrise View from the date
of October 17, 1994 and Frank's Place from September 6, 1994.
Both will expire 3 years from those dates.
