During that meeting they considered a request by Northwest Health Care for a conditional use permit to allow the expansion of an existing day care center from the current level of 12 or fewer children to a maximum of 24 children. The day care center serves the employees of Northwest Health Care. The facility is located on the northeast corner of Highway 93 North and Conway Drive and is zoned H-1, Health Care. The facility occupies the lower level of a two story building which has professional offices on the upper floor. A staff report was presented by Narda Wilson of the Flathead Regional Development Office who recommended approval of the expansion. She praised the hospital for providing these services, and stated that she believes the day care center can be held up as an exemplary model for other businesses in the community. Nancy Greer, representing Northwest Health Care, spoke in favor of the proposal and explained how the day care center operates. No other public testimony was given. The planning board praised the hospital and staff for providing this service and agreed that the day care center fulfills a critical need in the community. The planning board adopted the staff report as findings of fact on a 7-0 vote, and recommend that the city council grant the conditional use permit. Size and Location: The site is located on the southeast corner of Highway 93 and Conway Drive in Kalispell. The entire parcel is approximately 2.25 acres in size. There is an existing day care facility which is located in the lower level of the Health Promotion Center. The property can be described as Lot 1, Highland Park 2nd Addition located in Section 6, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. C. Nature of Request: The applicants are requesting a conditional use permit to allow the expansion of an existing daycare facility in the H-1, Health Care, district as provided for under Section 27.12.030(6) of the Kalispell Zoning Ordinance. The existing day care facility has been providing child care services to the employees of Northwest` Healthcare, but has been limited to less than 12 children. Under the proposed expansion, the daycare "center" would provide services for 13 to 24 children. The existing facility would be remodeled to accommodate the expansion within the lower level of the building. The upper level would continue to be used for professional offices. D. The property is zoned H-1, Health Care, and is part of the Northwest Healthcare medical complex. 1 E. F. G. H. Surrounding Zoning and Land Uses Zoning. The area surrounding this site can be described as a mix of medical and dental offices, technical service providers, pharmacy and other related health care services within the immediate area. Properties to the north, south and east are also zoned H-1, Health Care. Highway 93 is to the immediate west, with properties on the west side of the Highway being a mix of Commercial and Low Density Residential. These properties are generally accessed from Meridian Road. Master Plan Designation: This site lies within the boundaries of the Kalispell City -County Master Plan which designates this area as Medical/Professional. This land use designation is intended to provide for a v.-ide variety of medical needs, professional offices and services, as well as higher density residential uses. Compatible and supporting uses such as churches, daycare centers and other uses which would serve the needs of the people found in the area would be anticipated. This proposal supports the goals of the master plan. Site Suitability: a. Adequate Useable Space: Anavexisting two-story professional office building currently occupies ther-site where the daycare facility currently operates on the lower level. The site is approximately two acres in size and provides adequate space on the property for the existing and proposed uses. b. Adequate Access: Access to the .site is by way of an existing driveway from Conway Drive at the eastern end of the property. The approach and parking lot are paved. Access is good with regard to location, sight distance and the condition of the approach.. N C. Environmental Constraints: There ao not appear to be any significant environmental constrains associated with this property which should be considered with regard to this proposal. 2. Appropriate Design: a. Parking Scheme: There are currently approximately 92 developed parking spaces on site which serve the existing professional offices and the daycare facility. The Kalispell Zoning Ordinance requires one space per employee plus one loading space per six students. Anticipated parking would be five employee parking spaces and four loading spaces for a total of nine spaces. There is more than adequate parking to accommodate all of the existing and proposed uses on the property. b. Traffic Circulation: There is one paved approach from Conway Drive. Access to the child care facility is at the rear of the building, or the south side. There is an existing walkway from the parking area to the building. The parking area has adequate space to safely load and unload the children and to turn around to exit. Traffic circulation to and within the site is quite adequate. C. Open Space: No specific open space requirements would apply to this proposal other than adequate building setbacks which have been observed during the construction of the existing building. d. Fencing/ Screening/La.ndscapin : Currently the perimeter of this property is fenced except for the eastern boundary. Additionally there is a hedge and expansive lawn area along the western boundary which abuts Highway 93. There is also other substantial mature landscaping on the property which creates an aesthetically pleasing appearance of the building and grounds. e. Signage: There is currently signage on the property which relates to the professional office found on the upper story .of the building. No signage is proposed to advertise the daycare center. 3. Availability of Public Services/Facilities: a. Schools: This development is within the boundaries of School District #5. No impact on the school district can be anticipated as a result of this use. b. Parks and Recreation: The day care center would not have a significant impact on the parks and recreation facilities of the City. The day care facility currently has a developed play area for the 3 children, and other than an occasional outing, recreational facilities in the area would not be significantly impacted by this expansion. C. Police: This subdivision would be served by the Kalispell Police Department. No significant impact to the police can be anticipated as a result of this use. d. Fire Protection: Fire protection will be provided by the Kalispell Fire Department.. The remodeling of the building would have to comply with the building and fire codes, thereby, reducing the threat of fire to the building. No significant impact to the fire department can be anticipated as a result of this proposal. M C. Water: Currently this property receives City water. No significant impact on water services provided by the City can be anticipated. L Sewer: Sewer service is provided by the City of Kalispell. No significant impact on sewer services provided by the City can be anticipated. a g. Solid Waste: Solid waste pick-up is currently provided by the City. A container is currently in place toward the southwest end of the property. No significant impact can be anticipated as a result of this use. h. Roads: Conway Drive by way of Highway 93 provides access to this site. Both are paved roads in good condition which are adequate to accommodate traffic generated from this site. No substantial increase in traffic is anticipated. 4. Immediate Neighborhood Impact: The general character of this neighborhood is currently medical and professional offices. This use will have a positive impact on the area by providing a critical service in a convenient location zf Immediate Neighborhood Integrity: Daycare centers provide a vital service to b3c.,.atedi the community that requires quality child care which is conveniently located. This proposal will enhance the integrity of the neighborhood and the medical community in general - 'a 6., Impact on Property Values: The expansion of the daycare facility will have a `e�a ';.`aluabi, positive impact on property values in the area because is provides a valuable ".tn� and needed service to the community in a convenient and pleasant location. 4 A notice of public hearing was mailed to property owners within 150 feet of the subject property approximately 15 days prior to the hearing. At the writing of the staff report, no comments have been received by the staff. SUMMARY OF FINDINGS 1. The size and location of the site is adequate to accommodate the proposed expansion of the daycare facility. 2. The design of the site with regard to access, parking, landscaping and fencing is more than adequate to accommodate the proposed use. and the other uses on the site. 3. Existing public services and facilities are adequate to accommodate the proposed use. 4. Positive impacts to the neighborhood can be anticipated as a result of the expansion of the child care facility by providing a valuable service to the employees of the medical community. RECOMMENDATION It is recommended that the Kalispell City -County Planning Board adopt staff report #KCU-97-1 as findings of fact and recommend to the Kalispell City -County Planning Board that the Conditional Use Permit be granted subject to the following conditions: 1. Kid Care has been operating as a day care (less than 12 children) in the past but is now proposing to expand to a "center" status. A maximum of 13 children is proposed for child care in the near term but up to a total of 24 children may be accommodated in the long term. Although the latter number of children may never be realized, this application is requesting approval for a day care center having a range of care for 13 to 24 children. LOCATION: The existing Kid Kare facility is essentially occupying the same location and space as the proposed "center", which is in the lower level of the Health Promotion Center. Refer to the site plan of the "Kid Kare Proposed Remodel" for the actual location within the building. Another site plan is attached that depicts the original use of the space by the Health Promotion Center. The exterior of the Health Promotion Center is not being affected by the proposed use. REGIONAL SETTING: The proposed day care center is located in the lower level of the Health Promotion Center, which is conveniently located in the medical campus area of Kalispell. Attached is a Medical Campus map that. displays the various types of land uses in the vicinity. Conway Drive forms the northerly boundary to the lot and U.S. Highway 93 the westerly boundary. TRAFFIC FLOW: The day care service is only available to employees of Northwest Healthcare. As such, the children are essentially being transported to the employment area of their parents. This reduces the need for multiple trip destinations and overall trip length. Regional access to the day care is ,primarily from U.S. Highway 93 via the signaled intersection at Canwav Drive. INTERNAL MW ACCESS: Internal accr.-� "tokthe,,property is from Conway Drive into a large parking Iaf provides a circular travel pattern. Alternative egress/in , itsalsopossible onto Burns way via a common parking lot with various medical offices. Past experience with the operation of the Kid Care daycare indicates that 1/3 of the children are from common parents. The expected trip generation would be reduced by that ratio. The anticipated trips and associated vehicle movements are expected to be #negligible compared to the previous _use of the space for classes and general rehabilitation visits. PARKING: Expected employeet parking is likely to be 5 spaces. Sufficient area is available for the required 4 off-street loading spaces. The associated parking lot for the "Health Promotion Center" has at least 92 dedicated parking spaces. The need for these spaces was based on the past use of the building for medical purposes but those uses have now been transferred to the Summit. It is expected that the available spaces will be excessive regardless of the upper level use of the building. REFUSE & UTILITIES: These existing services will not be affected by the proposed use. SCREENING: The center will be located entirely within an existing building with no outside evidence of the use. SIGNS & YARDS: There will be no outside signage for the intended use. The lot is extensively landscaped and an outdoor play area is available adjacent to the day care center. STRUCTURE: Internal remodeling of an existing building will accommodate the proposed use. See related map attachment. OPEN SPACE: The day care incorporates the provision of 3 large play rooms and an adjoining outside play area. HOURS OF OPERATION: The day care center will operate from 6:00 am to 6:00 pm. NOISE, ETC: The proposed use will have no adverse impacts related to noise, light, dust, glare, or vibration. The Flathead Regional Development Office was represented by Narda Wilson, Senior Planner and Steve Kountz, Senior Planner. There were approximately 30 people in attendance. APPROVAL OF The minutes of the meeting of January 13, 1997 were approved as NIINU1'ES submitted on a motion by Kennedy, second by Johnson. By acclamation vote, all members present voted aye. NORTHWEST The first public hearing was introduced on a request by Northwest HEALTHCARE / Healthcare for a conditional use permit to allow the expansion of a day CONDITIONAL care center in an H-1, Health Care zoning district. The conditional use USE PERMIT / DAY permit would allow the expansion of the facility to serve a maximum of CARE CENTER 24 children. The property is located at the southeast corner of Conway Drive and Highway 93 North, and can be described as Lot 1, Highland Park 2°d Addition located in Section 6, Township 28 North, Range 21 West, P.M.M., Flathead County. Staff Report Wilson gave a presentation of report #KCU-97-1. The application was evaluated in accordance with the necessary criteria and based on the findings, staff wholeheartedly recommended the conditional use permit be granted subject to two conditions. Public Hearing The public hearing was opened to those in favor of the project. In Favor Nancy Greer, manager for women's and children's health care services for Northwest Healthcare, spoke in favor of the proposal, and was available for questions. No one else spoke either in favor or in opposition to the request. The public hearing was closed and the meeting opened to Board discussion. Board Discussion The Board asked if the day care facility had opening, if would serve those from outside the employees' pool? Mrs. Greer replied that with 1200 employees at Northwest Healthcare, that was not an issue, however, if it came up, it would be addressed at that time. Motion Kennedy made the motion to adopt staff report #KCU-97-1 as findings of fact and recommend that City Council grant the conditional use permit to Northwest Healthcare, subject to the two conditions set forth in the report. Conner seconded. On a roll call vote the Board voted 7-0 in favor of the motion. ANDERSON The next public hearing was introduced on a request by Anderson THEATRE Theatre Company, Inc., for a zone change from R-1, Suburban COMPANY / ZONE Residential,, to B-2, General Business on approximately 5.25 acres of CHANGE / FROM land located in the Evergreen Zoning District. The property is located on R-1 TO B-2 the west side of LaSalle Road and south of Evergreen School approximately 100 feet on the east end of the property proposed for rezoning and adjoins the school property along the east end of the property. The property can be described as the west 180 feet of Assessor's Tract 1L and all of Assessor's Tract ILA in Section 4, Township 28 North, Range 21 West, P.M.M., Flathead County. Staff Report Wilson presented an overview of report #FZC-97-1. The statutory basis for review of a zone change was evaluated and based on the findings, staff recommended the request for a zone change from R-1 to B-2 be granted. Staff amended her recommendation to include in the zone change, the western portion of Assessor's Tract 1LC, thus eliminating that island of R-1, which would result if the zone change is granted. A letter was received from the school in support of the zone change. Public Hearing The public hearing was opened to those in favor of the zone change request from R- I to B-2. In Favor Tim Lynch, was in favor of the zone change request. That is obviously a commercial piece of property. No one would want to put a home there. It lends a tremendous opportunity to the Evergreen School. With a theatre next door, I can envision a partnership going on between Anderson Theatre and the school. It offers an efficient travel for the consumers of the area. Tom Hines, representative for Anderson Theatre, spoke in favor of the proposal. They bought the property eight years ago with the idea of putting a twin theatre on it. We are envisioning a 4-plex theatre, designed to be added on as the capacity allows.
