AGENDA ITEM 4 - RESOLUTION 4315-ABANDON "A" STREET IN KNOLL'S
ADDITION
BACKGROUND/CONSIDERATION: As per our discussion at the last Work
Session, we have compiled a resolution to abandon "A" Street. We
have published the notice that the Public Hearing will be held
February 18th.
RECOMMENDATION: We have enclosed a corrected map for your review.
The abandonment is a "clean-up" of previous City
actions/agreements. I recommend that we complete this process.
ACTION REQUIRED: Completion of the Public Hearing is required.
Upon completion, Resolution 4315 will need to be APPROVED if this
is your desired action.
RESOLUTION NO. 4315
A RESOLUTION TO ABANDON AND DISCONTINUE THE DEDICATED PUBLIC STREET
KNOWN AS "A STREET" RUNNING ALONG THE NORTH SIDE OF LOT 9, BLOCK 5,
KNOLL'S ADDITION, KALISPELL, MONTANA.
WHEREAS, on the 30th day of September, 1996, the City of
Kalispell received a petition from Carver Engineering, Inc., on
behalf of Ronald M. Henry, Trustee for the Lloyd L. Dahl
Testamentary Trust, owner of Lot 9 through 16, Block 5, Knoll's
Addition, Kalispell, Flathead County, Montana, requesting that the
City of Kalispell abandon and discontinue the street located along
the north side of Lot 9, Block 5, Knoll's Addition, pursuant to
Section 7-14-4114, M.C.A., and
WHEREAS, notice of said petition was published in the Daily
Inter Lake on the 91h day of February, 1997, and
WHEREAS, on the 18th day of February, 1997 the City Council of
the City of Kalispell held a public hearing to hear proponents and
opponents on the closure and to further determine any action, that
would serve the public interest, and
WHEREAS, it was determined that the petition hereinbefore
mentioned was properly presented to the Council, and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. All that part of the City street located 20
feet running along the north side of Lot 9,
Block 5, Knoll's Addition, Kalispell, Montana,
is hereby discontinued as the same was never,
nor ever will be, used for public
transportation and the public interest will be
served by its discontinuance.
SEC_T_IDN_II. The enactment of this Resolution shall not
affect nor impair the right of any public or
municipal utility to continue to maintain its
plant or equipment in said street.

SECTIONIII. This Resolution shall take effect immediately
upon passage by the City Council and approval
by the Mayor.

On behalf of Ronald M. Henry, Trustee for the Lloyd L. Dahl Testamentary Trust,
owner of Lots 9 - 16, Block 5, Knoll's Addition, we request that "A Street", as
shown on the recorded plat of Knoll's Addition, be abandoned. "A Street" is a 20-
foot strip of land running along the north side of Lot 9, Block 5, Knoll's Addition,
and it has never been, nor will it ever be, used for public transportation.
This 20-foot strip of land has, for the most part, been taken over by the adjoining
property owners, the Kalispell Congregation of the Jehovah's Witness, as an
expanded lawn area. With the recent abandonment of a portion' of Grandview
Avenue (Resolution No. 4187) along the west ends of Lots 9 - 16, and the recent
construction of a 24-foot paved roadway and cul-de-sac along the east ends of
Lots 9 - 16, A Street really could never be used for public transportation.
We are enclosing copies of a Plat of Knoll's Addition, a quarter -section map and
a Certificate of Survey No. 12063 that created a 40-foot road & utility easement
along the east ends of Lots 9 - 16, Block 5 for your reference. Please call if you
have any questions, or if you find that additional information is needed.
