Re: Final Plat for Woodland Court Subdivision
Dear Clarence:
Our office has received the application for final plat approval of Woodland Court Subdivision, a
24 lot residential subdivision on approximately seven acres located on the east side of South
Woodland Drive in Kalispell.
Preliminary plat approval was granted by the City Council on January 17 1995 with Resolution
-- 4194 subject to 14 conditions. The following is a list of the conditions of approval and a
discussion of how they have been met.
COMPLIANCE WITH CONDITIONS OF APPROVAL
1. Development of this property shall be in substantial conformance with the approved
preliminary plat.
This condition has been met. The lots are in substantial compliance with the preliminary
plat approved by the City Council. A letter from the engineer dated December 12, 1996
has been included in the final plat applicant which certifies that the final plat meets this
condition.
2. The development shall comply with all subdivision and zoning ordinance requirements.
This condition has been met. The lots are in compliance with the R-2 zoning designation
for this property.
3. The subdivision shall be approved the State Department of Health and Environmental
Sciences.

This condition has been met. A letter from the Department of Environmental Quality
dated October 23, 1995, E.Q. #96-1429, approving the water and sewer facilities for the
subdivision has been submitted with the final plat application.
4. The applicant shall install a mailbox location in conformance to a plan approved by the
U.S. Postal Service.
This condition has been met. A letter from the U.S.P.S. dated August 1, 1996 approving
the mailbox location has been submitted with the final plat application.
5. The developer shall provide a minimum 50 foot right-of-way for Woodland Court.
This condition has been met. A letter from the engineer dated December 12, 996 certifies
that this condition has been met and the right-of-way is shown on the final plat.
6. Sidewalks shall be installed along South Woodland Drive in accordance with City
standards.
This condition has been met. A letter from the Assistant City Engineer dated December
13, 1996 certifying that the sidewalks have been installed which meet City standards has
been submitted with the final plat application.
7. The 10 foot future right-of-way expansion along South Woodland Drive be eliminated
and the area included in the lots.
This condition has been met. The right-of-way has been eliminated from the final plat
and included in the lots.
8. The developer shall install street trees and one additional tree per lot; and at a minimum,
plat grass seed in the front yards with a soil stabilizer to inhibit erosion on each lot.
This condition has been met. The City of Kalispell has encumbered funds for the
required landscaping as approved by the Parks and Recreation Department. A letter from
the Assistant Finance Director dated December 13, 1996 stating that this has been done
has been included with the final plat application.
9. The developer install landscaping in the homeowners park as approved by the City's Park
Department Director. In addition, cash -in -lieu of parkland fee of $7,10 be paid.
This condition has been met. The required cash amount has been transferred to the City
Parks and Recreation Department's account. A letter from the City Finance Director
dated December 9, 1996 certifying that this has been has been submitted with the final
plat application.

10. The covenants be amended to include information on ownership and maintenance'
responsibilities for the homeowners park. This includes percentage of ownership per lot
for tax purposes, and that the city Council shall approve any proposed amendments to the
covenants.
This condition has been met. The City will maintaining the park area thereby negating
the need to amend the covenants to include information on the park. Covenants have
been prepared by the Kalispell City Attorney addressing this condition and have been
submitted with the final plat application.
11. On the face of the final plat indicate gross and net acres for each lot. Net acreage to be
the area of the lot as outlined on the plat and gross acreage to include 1/24 of the area
contained in the homeowners park indicating it as such for taxation purposes.
This condition has been met. Each of the lots indicate a gross and net acreage.
12. All utilities shall be installed underground.
This condition has been met. A letter from the engineer dated December 12, 1996 which
f certifies that the utilities have been installed as required has been submitted with the final
plat application.
13. A storm water drainage plan be submitted to and approved by the City's Public Works
Director.
This condition has been met. A letter dated November 20, 1996 from the Assistant City
Engineer approving the storm water drainage plan has been submitted with the final plat
application.
14. Fire hydrants shall be placed in accordance with a plan approved by the City's fire Chief.
This condition has been met. A letter dated October 25, 1996 from the City Fire Chief
approving the fire hydrants for this subdivision has been submitted with the final plat
application.
COMPLIANCE WITH APPROVED PRELIMINARY PLAT
The final plat is in substantial compliance with the preliminary plat which was submitted and
approved.

COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in substantial compliance with the State and City
Subdivision Regulations.
COMPLIANCE WITH THE ZONING REGULATIONS
This subdivision has been found to be in compliance with the Kalispell Zoning Ordinance.
RECOMMENDATION:
All of the conditions of preliminary plat approval have been adequately met. The Flathead
Regional Development Office recommends that the Kalispell City Council approve the final plat
for Woodland Court Subdivision. Please schedule this matter for the City Council work session
scheduled for January 27, 1997 and subsequent regular meeting on February 3, 1997. Please call
