Re: Final Plat for Teton Terrace Subdivision
Dear Clarence:
Our office has received the application for final plat approval of Teton Terrace Subdivision, a 26
lot residential subdivision on 4.2 acres located approximately two blocks north of Two Mile
Drive, on the west side of Hawthorn Avenue in Kalispell.
Preliminary plat approval was granted by the City Council on January 2, 1996 with Resolution
4249 subject to 15 conditions. A conditional use permit for a cluster development was also
granted by the City Council concurrent with the preliminary plat. The following is a list of the
conditions of approval and a discussion of how they have been met.

1. Development of this property shall be in substantial conformance with the approved
conditional use permit site plan and preliminary plat.
This condition has been met. The lots are in substantial compliance with the preliminary
plat and the conditional use permit site plan approved by the City Council. A letter from
the engineer dated December 12, 1996 has been included in the final plat applicant which
certifies that the final plat meets this condition.
2. Approval of Teton Terrace supersedes any approval for previous subdivisions at this
location.
This condition has been met. No action is required on the part of the applicant.
3. The development shall comply with all subdivision and zoning ordinance requirements..
This condition has been met. The development has been found to be in compliance with
the subdivision and zoning regulations for the city of Kalispell. The engineer has

submitted a letter dated December 12, 1996 certifying that the above condition has been
met.
4. The name of the subdivision on the final plat shall include information that his is an
amendment of Porta. Villa Number 3, Lot 6.
This condition has been met. The final plat includes the name of the subdivision Porta
Villa in the title block.
5. The subdivision shall be approved by the State Department of Environmental Quality.
This condition has been met. A letter from DEQ dated May 21, 1996 approves Teton
Terrace Subdivision water and sewer facilities.
6. The applicant shall install a mailbox location in conformance to a plan approved by the
U.S. Postal Service
This condition has been met. A letter from the post office dated March 8, 1996 states that
a suitable location for mail delivery has been established.
7. The developer shall provide a minimum 60 foot right-of-way for Teton Avenue and a
minimum 50 foot right-of-way for Iris Court with improvements to allow for parking on
both sides, curb, gutter, sidewalks, and street lights in accordance with the Design and
Construction Standards adopted by the City.
This condition has been met. A letter from the engineer dated December 12, 1996
certifying that this condition has been met has been included with the final plat
application materials.
8. Cash -in -lieu of parkland fee of $12,166 shall be paid to the City for parkland.
This condition has been met. The City of Kalispell has transferred the required amount of
cash -in -lieu of parkland fee to the City Parks and Recreation Department's account. A
letter from the City Finance Director dated December 9, 1996 certifies that this money
has been transferred.
9. The covenants be created describing the homeowner's association membership,
architectural standards, use and maintenance of property (open space, driveways, tot lot,
etc.), and maintenance of the sidewalks. In addition, it should include the City Council as
the approving authority for any amendments (as well as the homeowners association).

This condition has been met. The covenants have been prepared by the Kalispell City
Attorney and submitted with the final plat application.
10. On the face of the final plat indicate gross and net acres for each lot. Net acreage to be
the area of the lot as outlined on the plat and the gross acreage to include 1/26 of the area
contained in the common area indicating it as such for taxation purposes.
This condition has been met. The required notes on the acreage have been included on
the face of the final plat.
11. All utilities shall be installed underground.
This condition has been met. A letter from the engineer dated December 12, 1996
certifies that this condition has been met.
12. A storm water drainage plan shall be submitted to and approved by the City' Public
Works Director.
This condition has been met. A letter dated November 20, 1996 from the Assistant City
Engineer approving the storm water drainage plan has been submitted with the final plat
application.
13. Fire hydrants shall be placed in accordance with a plan approved by the City's Fire Chief.
This condition has been met. A letter dated November 15, 1996 from the Assistant Fire
Chief approving the fire hydrants has been submitted with the final plat application.
14. The conditional use permit shall terminate with the termination of the preliminary plat if
commencement of the project has not begun. Any extension of time granted the
preliminary plat shall extend the conditional use permit.
This condition has been met. The final plat has been filed prior to expiration.
15. The preliminary plat shall expire three years from the date of Council approval. One one-
year extension may be granted by Council; any request for extension must be submitted
minimum of 30 days prior to expiration.
This condition has been met. The final plat has been submitted prior to the expiration of
the preliminary plat.

COMPLIANCE WITH APPROVED PRELIMINARY PLAT
The final plat is in substantial compliance with the preliminary plat which was submitted and
approved.
COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in substantial compliance with the State and City
Subdivision Regulations.
COMPLIANCE WITH THE ZONING REGULATIONS AND CONDITIONAL USE PERMIT
This subdivision has been found to be in compliance with the Kalispell zoning regulations and
the conditional use permit granted for the cluster development.

All of the conditions of preliminary plat approval have been adequately met or otherwise
addressed. The Flathead Regional Development Office recommends that the Kalispell City
Council approve the final plat for Teton Terrace. Please schedule this matter for the City
Council work session ON January 27, 1997 and subsequent regular meeting ON February 3,
