Extension

BACKGROUND: This is a request by Stillwater Corporation to extend the PUD approval on the
Glacier Town Center PUD for one year. Glacier Town Center received PUD approval in February 2008,
along with annexation of the property and phase 1 of the Glacier Town Center preliminary plat. In the
intervening years, the PUD and the associated preliminary plat phase have been granted successive
extensions.
The associated preliminary plat is set to expire in January 2015 in accordance with Resolution
5595. The owners of the property, Stillwater Corporation, have elected to allow the preliminary plat to
expire without filing a final plat application and to reevaluate the phasing plan and product types in light
of current market conditions. They have indicated their intention to eventually develop the property and
would like to maintain the PUD overlay zoning for a subsequent, new preliminary plat proposal.
The Kalispell Zoning Regulations, in Section 27.19.020(10)(b), provide that an approved PUD
associated with a preliminary plat will expire at the same time as the plat if it allowed to lapse. If the
PUD lapses, the underlying zoning designation remains in place, but all of the associated conditions of
PUD approval expire. When this happens, the project would then revert to a "PUD Placeholder" status,
requiring a new "PUD Full" application. This section of regulations ask that the landowner/developer
request an extension of the PUD at least 30 days before the expiration of the associated preliminary plat in
order to keep the Full PUD in effect and its associated conditions. The code states that the council may
grant one or more such extensions.
Glacier Town Center PUD encompasses 485.5 acres and extends from Highway 93 North to
Whitefish Stage Road. The property is generally bounded by Glacier Memorial Gardens cemetery, the
Stillwater River, West Reserve Drive, and Applied Materials along its southern boundary; Whitefish
Stage Road on its eastern boundary; and a combination of privately -owned, incorporated and
unincorporated land along its northern boundary.
Glacier Town Center PUD zoning overlay includes the four zoning designations of R-3 (single-
family residential), R-4 (two-family residential), B-1 (neighborhood business), and B-2 (general
business). The PUD proposes to ultimately develop 282 single-family residential lots, 150 townhouse
lots, 200 apartment/condominium units, approximately 1.8 million square feet of commercial/office
space, and 72.3 acres of parks and open space.
RECOMMENDATION: It is recommended that the city council adopt the first reading of the ordinance
and grant a one year extension to the Glacier Town Center PUD.
FISCAL EFFECTS: Minor positive impacts until actual PUD begins then significant positive impacts.
ALTERNATIVES: Deny the request.

WHEREAS, the City Council of the City of Kalispell approved the Glacier Town Center Planned
Unit Development Agreement on February 4, 2008; and
WHEREAS, property owner Stillwater Corporation now desires a one-year extension to the
Planned Unit Development due to economic conditions; and
WHEREAS, it is in the best interests of the City of Kalispell that the Glacier Town Center
Planned Unit Development Agreement be amended as set forth below.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION 1. That the Glacier Town Center Planned Unit Development shall be extended
for a period of one year until February, 2016.
SECTION 2. This Ordinance shall take effect from and after 30 days of its passage by the
City Council.

Dear Tom,
I am writing to request an extension of the Glacier Town Center PUD Zoning Overlay.
It is our intention to eventually develop the property. Although the Preliminary Plat
Phase I expires in January 2015, we intend to file a new Preliminary Plat once our
planning is complete. We are reevaluating the phasing and product types in the original
plan based on current market conditions. Although our planning and market studies are
not complete at this time, we continue to feel that the existing PUD Zoning Overlay
remains appropriate for the project.
Please consider our request for an extension and let me know if you need additional
information.
