5. Public Hearing - Green Acres Annexation ProcessDecember 2, 1996 A. RESOLUTION 4305-Neighborhood Plan This resolution approval would complete the formal adoption of the Neighborhood Plan. This document was received at the last regular meeting (pink cover). Please bring it with you. If you do not have one, please let us know so we can have one available for you Monday night. B. MOTION TO ADOPT EXTENSION OF SERVICES PLAN Extension of services plan would formalize our intended actions for services and improvements. Further discussion of staff has resulted in additional items that should be incorporated into the extension of services plan. These additions have been inserted into the plan by FRDO. I have enclosed the memorandum from Narda to enable you to see the specific changes to the plan. C. RESOLUTION 4306-Annexation and Initial Zoning This would be the final approval and completion of the annexation and zoning process. D. ORDINANCE 1253-Zoning-1st Reading The zoning as outlined in the proposed boundaries of the South Woodland/Greenacres Neighborhood Plan. December 2, 1996 RECOMMENDATION: The process that the City staff, FRDO, Council and the Greenacres Homeowners Association have participated in for the last few months has been successful in processing information, addressing concerns, and arriving at equitable solutions for the City and the proposed annexation area. Involuntary annexations are difficult and not everyone will be satisfied. I do believe that both the City and the Greenacres citizens are in a "win" situation with this annexation. I highly recommend that we complete the final process items for this annexation. ACTION REQUIRED: As outlined above: A. RESOLUTION 4305 - Adopt Neighborhood Plan. B. We could decrease the boundaries but cannot increase the boundaries within the current process. C. I do not want to be annexed. We do not at present, use City services nor do we expect to in the future. We have a well and septic system and already contract for refuse disposal. We are satisfied with the county's level of services provided and feel the increase in property taxes by the City of Kalispell will not equal the level of services it proposes to provide. I am retired, only have s.s and cannot afford any higher taxes and I do not want to have to give up my home because I couldn't afford to stay in it. Please consider how much harder it would be on some of us to pay more taxes. It has been our experience that the City of Kalispell does not live up to its promises. In no way do we favor the annexation into the city limits. Once we are annexed the promises will be forgotten and we will be burdened with higher taxes. Please take our wishes into consideration when making your decision on this annexation. We purchased this property because it was located outside of the city limits. We are both on disability retirement, which means we are on a fixed income and we are not in favor of this proposed annexation. The higher cost and higher taxes incurred by the annexation by the City will only result in higher rents, causing an added and unneeded financial burden, on the low and fixed income residents of the park. We oppose annexation by the City as we cannot afford the increase in taxes, sewer, water hookup fees, SID;s and the many costs associated with annexation. There are many retirees and young families who are struggling to make ends meet, who live in Greenacres. The high taxes, etc. may be unaffordable to many forcing them from their homes. We are satisfied with our present water system. We all have large lots in Greenacres. We also are concerned with high water bills, due to our large lawns, flowers etc. Since the City sewer line runs down south Woodland Drive why not let those who are having sewer problems hook up to the City sewer without annexation. We live on Bison Drive and have no sewer problems. We are happy with our present water system and we are very concerned with an increase in taxes and living costs. It would be of no advantage to us to be annexed. We are retired people and live on a limited income, hence paying higher taxes would be a real burden. Our neighborhood is served very capably by the South Kalispell Volunteer Fire Department, the Greenacres homeowner's Association water system, the Flathead County Road Department and the Flathead County Sheriff's Department. We have no reason to believe that the City will be able to provide better or faster service. I seriously question whether annexation would downgrade rather than upgrade our fire protection ratings. I know for a fact that even if, by some chance the rating were improved, no insurance savings will ever approach compensation for the tax increase. But what would really be noticeable would be the huge increase in water bills and the annual tax assessment. We fail to see how annexation would be in our best interests. WE purchased this property in about 1944 for a place to retire when we got too old to work. We wanted out in the country. At that time there was nothing east and southeast of the old hospital so we were away out in the country at that time. We are in our eighties and on a fixed income now and our taxes now is over $700 and with all of our living expenses we are able to get by. But if our taxes are doubled I don't know how we could pay them. It would make a hardship on us senior citizens. So you see why we do not want to be annexed to the City. We bought this land because it was county and zoned R-2. We have been to many meetings about rezoning to R-4, so the City could develop land for low income, but I do not want to pay for this development project, and sewer problems in south Greenacres. The City has been giving building permits in this area with no concerns to the sewer problems. It is about time they put the problem back onto themselves and not ask us to pay for the problems they have caused. We have good water and good sewer, we do not need the City's services nor want them. I feel you are trying backwards ways of collecting more tax revenue. We do not want any part of this and if necessary we will take legal action against the City. Listen to the people who are paying your wages. We do not want it nor did we ask for it. With all due respect, you offer us nothing we do not already receive in the county. The only asset is to you, to gain more taxes. No thank you. We are being offered no advantages to being annexed. Our taxes will almost double, and that is what is described as piracy. Also there is some property along Kelly Road that you have marked as not or no annexation, would you please explain as to why and who owns this property? What is going on with this property that you would not want it inside the city limits along with all the other properties around it? I
