Our office has received the application for final plat approval of Ashley Park, Phase II. This
property is located in the southeast area of Kalispell off of Airport Road. The property has
access from Airport Road, through Ashley Park, Phase I.
Preliminary plat approval was granted by the Board of County Commissioners on May 10, 1994
subject to 14 conditions of approval. The entire subdivision contains approximately eight phases
which will be final platted along with their annexation into the City of Kalispell.
This final plat and petition for annexation is being sent to you to be scheduled for the November
12, 1996 Council work session and subsequent November 18, 1996 regular meeting for final
action. Note that the hearing for initial zoning upon annexation will be held on November 14,
1996 before the Kalispell City -County Planning Board, therefore planning board minutes will
not likely be available. However, this is a very non -controversial item as the developer has
petitioned annexation and all improvements will have been constructed to City standards.
The dates for review by the Council are an attempt to "fast track" this project so that the
developer can record the final plat and begin construction.
The following is a list of the conditions of approval and a discussion of how they have been met.
COMPLIANCE WITH CONDITIONS OF APPROVAL
1. That the subdivision obtain approval from the State Department of Health and
Environmental Sciences.
This condition has been met. The subdivision has been approved by the State Department of
Environmental Quality under the Master Plan Exemption for areas served by municipal water
and sewer. See letter dated March 1, 1996 from DEQ.

2. All water lines, sanitary sewer, culverts, and storm sewer lines/swales shall be built
according to plans and specifications approved by the City of Kalispell Public Works
Department. All water, sewer main extensions, and storm sewer lines/swales on private
property shall be placed within suitable easements and approved by the City of Kalispell
Public Works Department.
This condition has been met. See the letter of approval from the Kalispell Public Work
Department dated September 24, 1996.
3. The construction of all streets, curb, gutter, sidewalks and street tree planting shall be
done in compliance with City of Kalispell standards and approved by the City Public
Works Department.
This condition has been met. See the letter of approval from the Kalispell Public Work
Department dated September 24, 1996.
4. A 20 foot reserved strip for right-of-way be maintained along the westerly boundary in
common with the rail ROW for the future Alternate Highway 93 route. If the highway
is constructed prior to final plat of Phases 6 and 7 any remainder not used for ROW may
be included into to adjoining lots, so as to increase their depth.
This condition has been met. The northerly access road between Ashley Park and South
Meadows has been constructed according to the engineer's letter dated September 25, 1996.
5. Prior to Final Plat of Phase 2, installation of the northerly access route through South
Meadows is to be completed.
This condition has been met. See the letter of approval from the Kalispell Public Work
Department dated September 24, 1996.
6. All utilities shall be installed underground.
This condition has been met. See the letter of approval from the Kalispell Public Work
Department dated September 24, 1996.
7. The owner shall pay a cash -in -lieu of parkland payment equal to 1/9 of the undeveloped
market value of that portion of the site proposed for Final Plat.

This condition has been met. A cash -in -lieu of parkland fee in the amount of $2,411 has been
included with the final plat application.
8. Placement of fire hydrants shall be approved by the City of Kalispell Fire Department.
This condition has been met. The placement and locations of the hydrants has been reviewed
and approved by the Kalispell Fire Chief, Ted Waggoner.
9. This preliminary plat approval is valid for a period of two years. The project is also
approved in seven (7) phases. This two year period is based on approval of Final Plat
of Phase 1 within this two (2) years. Upon approval of each phase an additional two (2)
years to receive Final Plat for the next phase is granted. A one (1) year extension may
be granted for each individual phase. If any phase expires, the remaining unrecorded
phases also expire.
This condition has been met. Final plats for the phases of the subdivision has been filed in a
timely manner.

10. The lots meet the City of Kalispell Zoning Regulations.
This condition has been met. All of the lots within the subdivision meet the minimum standards
of 6,000 square feet in the R-4 zoning district.
11. Lot numbers, street addresses, and net acreage for each lot shall be included on the face
of the final plat.
This condition has been met. Required notes have be placed on the face of the final plat.
12. All streets shall be clearly signed in a manner conforming to City standards.
This condition has been met. See the letter from the Kalispell Public Works Department dated
September 24, 1996.
13. Prior to final plat of each phase, a petition to annex for that phase shall be presented to
the City of Kalispell. (Amended 6/22/94 by the Board of County Commissioners.)
This condition has been met. A petition for annexation has been filed and the annexation request
is being processed by the staff concurrent with this final plat application.

14. Street tree planting shall be coordinated in partnership with the City of Kalispell Parks
Department.
This condition has been somewhat addressed. The developer has stated in his letter of final
application that he would coordinate in partnership with the City of Kalispell Parks Department
regard the street tree planting. However, no binding agreement has been made.
The final plat is in substantial compliance with the preliminary plat which was submitted and
approved.
COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in substantial compliance with the State and City
Subdivision Regulations.
RECOMMENDATION:
All of the conditions of preliminary plat approval have been adequately met or otherwise
addressed. The Flathead Regional Development Office recommends that the Kalispell City
Council approve the final plat. Please schedule this matter for the City Council work session
scheduled for November 12, 1996 and the subsequent regular meeting on November 18, 1996
for final action.

This letter is to confirm the Ashely Park Phase II subdivision has met all final plat
conditions which require Kalispell Public Works Department approval. We have
