06. Resolution 4301 - North Meridian Road Change Orderi 11 iiiiFi'! i Ii11111 BACKGROUND/CONSIDERATION: This request for Change Order #1 in the amount of $6,770 for SMD Engineering is due to the unanticipated extent of major underground utilities located in the vicinity of North Meridian Road. This original contract was for $10,771.56 to complete phase 1 of the utility location. However, the actual work performed by the subcontractor of $17,541.90 records research and locating based upon a total of 69 pages of utility drawings was more than anticipated and more time was needed to complete the utility location and relationships. RECOMMENDATION: Although I prefer projects be completed within contracted amounts, I have, after 25 years of experience, learned to anticipate any project that deals with underground work will almost always result in "increase" change orders. Because of the scope of this project, the need to accurately locate all underground structures, and the fact that we would be required to pay for 'the locations whenever the. project is undertaken, I recommend Change Order #1 be approved. ACTION REQUIRED: A MOTION to approve Change Order #1 in the amount of $6,770 will authorize payment for the actual work performed. RESOLUTION NO. --43QJ A RESOLUTION TO ALTER AND AMEND THE CONTRACT WITH ROBERT PECCIA AND ASSOCIATES ON NORTH MERIDIAN ROAD, STPU 6701(5). WHEREAS, the City on October 10, 1995 did enter into a contract with Robert Peccia and Associates, Helena, MT for engineering and design on North Meridian Road, STPU 6701(5), and WHEREAS, SMD, Consulting Engineers, under a subcontract to Peccia and Associates exceeded estimates for location of underground facilities; and said exceeding of estimates could not have been necessarily foreseeable when the original contract on this phase of the engineering was entered into, and said changes are contained in Exhibit "A", attached hereto and are by this reference made a part hereof; and WHEREAS, upon the advise and recommendation of Peccia and Associates, it appears in the best interests of the City to approve said changes and alterations. NOW THEREFORE, pursuant to t ' he provisions of Section 7-5- 4308(1) MCA be it hereby resolved: 1. The alterations and modifications of the contract between the City of Kalispell and Peccia and Associates, dated October 15, 1995, as set out in Exhibit "A" attached hereto are hereby approved, and 2. As soon as the price to be paid for said alterations and modifications are agreed to in writing, signed by the engineer, as hereby approved by the Council, this approval thereof shall be in effect. As you are aware SMD's proposed estimate for phase 1 of this project was $10.771.56 we had actual time and materials totaling $17,541.90. The project engineer assigned to this project failed to read your contract requiring SMD to have written permission to exceed the budget amount of $10.771.56, He treated this project with the same guidelines that we work under for MDOT. We furnish a complete daily diary accounting for every hour charged to this project. When SMD estimates SUE projects we have very incomplete data on the underground facilities in the area therefore we make it quite clear that our proposal is just an estimate and not a firm proposal. Peccia furnished us with a set of highway plans with little to no underground facilities, with these plans Tom Pankratz prepared an estimate. We then requested from your firm additional drawings for water, sewer storm and drainage for the project you sent us 24 sheets of drawings. SMD obtained 21 drawings from the city of Kalispell on their water system, 9 drawings from Montana Power Company on their gas system, 13 drawings from PTI on communications and 2 drawings from MDOT on signal light circuitry. With the amount of underground facilities in the area SMD's estimate was under quoted immediately. Records research and locating would required much more time than estimated. You should have noticed that I reduced the rate for records research and locating engineer on the submitted invoice. I also furnished complete daily diaries for the project. SMD would like to be compensated for the additional work required on the unknown utilities. The SUE contracts with the state function in the same manner. SMD gives an estimate of services, completes the work required, furnishes a complete diary with accurate maps, and invoices actual amounts.
