Syth Business Park Revised Plat - Final ApprovalAGENDA ITEM 2 - SYTH BUSINESS PARK REVISED PLAT -FINAL APPROVAL On September 9 preliminary plat approval was granted by the City Council subject to ten conditions of approval which have been met. Drawer 1997 Kalispell, MT 59901 Re: Syth Business Park Revised Plat - Final Approval Dear Clarence: Our office has received the application for the final approval for Syth Business Park, a 14 unit commercial condominium project which was conditionally approved by the City Council on September 9, 1996 by passing Resolution 4293. The site is located between Airport Road and First Avenue West, south of 12th Street West approximately 400 feet. The property address is 1340 Airport Road, Kalispell and can be further described as Assessors Tract 8D in Section 18, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. Preliminary plat approval was granted by the City Council subject to ten conditions of approval. The following is a list of the conditions of approval and a discussion of how they have been met. COMPLIANCE WITH CONDITIONS OF APPROVAL 1. Provide encroachment permits from the City of Kalispell Public Works Department for the accesses onto Airport Road and First Avenue West. This condition has been addressed. See the attached letter from the Kalispell Public Works Department dated October 7, 1996. 2. Water and sewer facilities shall be approved by the City of Kalispell. The existing water and sewer lines shall be surveyed and an easement shall be shown on the revised preliminary (final) plat. This condition has been met. The easements are noted on the final plat. 3. All drainage shall be maintained on -site and that a drainage plan shall be approved by the Kalispell Public Works Department. This condition has been addressed. See the attached letter from the Kalispell Public Works Department dated October 7, 1996. Address numbers will be visible from the road either at the driveway entrance or on the building. This condition has been met. House numbering is addressed in the covenants. 5. That all utilities be placed underground. This condition will be met. Existing utilities are underground. Remaining utilities will also be placed underground. 6. That landscaping be done in accordance with the requirements outlined in the Kalispell Zoning Ordinance. This condition will be adequately addressed. The applicant will file a subdivision improvements agreement with the City of Kalispell and post a bond in the amount of 125 % of the cost of the remaining improvements. 7. That a landowners association be created to provide for the year-round maintenance of all common areas including the roads and parking lots, landscape areas and pedestrian walkways. This condition has been addressed. The covenants address the maintenance of the common areas. 8. That the development comply with all of the provisions of the Unit Ownership Act, Sections 70-23--102 through 70-23-702, M.C.A. This condition has been addressed. The necessary documents will be filed with the Clerk and Recorders Office upon approval of the revised preliminary plat. 9. That the Kalispell Fire Department provide written approval of the fire suppression system for Syth Business Park. This condition has been met. See the attached letter from the Kalispell Fire Department dated September 19, 1996. 10. That all uses within the buildings comply with the Kalispell Zoning Ordinance. This condition has been addressed. The covenants require compliance with the Kalispell Zoning Ordinance. This condition has been met. Staff has verified that the signs are in place with a routine site visit. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The revised preliminary plat is in substantial compliance with the preliminary plat which was submitted and approved. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in substantial compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE KALISPELL ZONING ORDINANCE The revised preliminary plat is in substantial compliance with the Kalispell Zoning Ordinance. RECOMMENDATION: All of the conditions of preliminary plat approval have been adequately met or otherwise addressed. The Flathead Regional Development Office recommends that the Kalispell City Council approve the final plat. Please schedule this matter for the City Council work session scheduled for October 15, 1996 and subsequent regular meeting, October 21, 1996, for final action. Lauren Granmo Ward III Although we did not issue a specific encroachment permit, access to the site from Airport Road and First Avenue West was reviewed and approved through the Site Pamela B. Kennedy Ward IV Review process. It is typical for this department to forego a separate permit in this M. Duane Larson situation. Ward IV A drainage plan was reviewed last summer and approved by the Public Works Department. The plan was apparently modified during construction, with changes is finish grade and catch basin locations. The finished portion of the site appears to be draining well, but the pavement and final grading are not in place for the north part of the project.
