Avenue West between 6th Street West and 5th Street West
BACKGROUND/CONSIDERATION: I have enclosed the request from Mr. Don
Hatch, Assistant Principal of the High School, to restrict the
parking on this street. The request also includes the signature of
residents/owners of the abutting properties.
RECOMMENDATION: It is quite apparent that there is a problem in
this area in terms of noise, loitering, congestion, etc. However,
the biggest problem is with the traffic safety; turning movements,
sight problems, and pedestrian/vehicle interrelationships. As per
our discussion with the High School Staff, neighborhood, and City
Staff at our workshop, I believe we all agree that this restriction
could result in safety improvements. I recommend the approval of
the request and have enclosed the ordinance to authorize the "no
parking"'on•this street.
ACTION REQUIRED: Approval of the ORDINANCE 1249 is required to
authorize the parking restrictions.
ORDINANCE NO. 1249
AN ORDINANCE TO AMEND SECTION 17-54, KALISPELL CITY CODE, TO
PROHIBIT VEHICLE PARKING ON THE WEST AND EAST SIDE OF 4TH AVENUE
WEST BETWEEN 5TH STREET WEST AND 6TH STREET WEST, AND DECLARING THE
EXISTENCE OF AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
SECTION I. Except as otherwise provided in this section it
shall be unlawful for any person to stop, stand, or
park or permit to be parked any vehicles of any
character on or in any of the following areas
within the City:
dd) On the West and East side of 4th Avenue West between 5th
Street West and 6th Street West on days when school is in
session between the hours of 8:00 A.M. and 5:00 P.M.
SECTION II. An emergency is hereby declared to exist in the
City of Kalispell because regulating the parking of
vehicles on 4th Street West, as set forth herein,
will promote the health, safety and welfare of the
community. Under the provisions of Sections 7-5-
104 and 7-5-4204, MCA, this Ordinance shall take
effect immediately and expire from and after 90
days of its passage and approval by the City
Council and Mayor.

Gene Boyle, Dan English and myself Sept. 17, 1996 in Mrs. McDevitt's office. It was
suggested we survey the people who live on 4th Ave. W. from 6th St. W. to 5th St. W.
Only one did not care to sign the petition.
