05. Resolution 4295 - Authorize Sale of South Woodland LotsAGENDA ITEM 5 - RESOLUTION 4295-AUTHORIZE SALE OF SOUTH WOODLAND • BACKGROUND/CONSIDERATION: The sale of two of the South Woodland lots is imminent. To allow this and to expedite the transaction to be complete, we need formal approval from the Council. RECOMMENDATION: I highly recommend that the sale of lots 17 and 24 be approved with authorization for the Manager to sign all of the closing documents. ACTION REQUIRED: Approval of RESOLUTION 4295. RESOLUTION NO. 4295 A RESOLUTION AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY FINANCE DIRECTOR TO EXECUTE THE DOCUMENTS NECESSARY TO SELL LOTS 17 AND 24 OF SOUTH WOODLAND COURT TO THE FLATHEAD BUILDING ASSOCIATION. WHEREAS, the City of Kalispell, a municipal corporation, owns certain real property, to -wit: Lots 17 and 24 of South Woodland Court, according to the map or plat thereof on file in the office of the Clerk and Recorder of Flathead County, Montana, and WHEREAS, the City created and improved the property to make property available to low income first time home buyers in the South Woodland Subdivision in the City of Kalispell, and WHEREAS, Section 7-8-4201, MCA, authorizes the City Council to sell, dispose of or lease any property belonging to the City upon proper passage of an Ordinance or Resolution passed by two-thirds vote of all members of the City Council, and WHEREAS, the property is not held in trust by the City for a specific purpose and therefore does not require an election in order to authorize its disposal, and WHEREAS, the property is not necessary for the conduct of City business nor for the preservation of property owned by the City and it is in the best interest of the City and its inhabitants to sell said property, and WHEREAS, the City Council desires to dispose of said property by selling said property to the Flathead Building Association in accordance with the provisions of Section 7-8-101, MCA, and WHEREAS, on the 17th day of June, 1996 the City Council did pass Resolution No. 4271, declaring an intention to dispose of said property by selling said property at a market price of $8,000.00 per lot. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION I. That the Mayor or City Manager and Finance Director are hereby authorized to execute all the necessary documents to sell all the right, title and interest that the City has in Lots 17 and 24 of South Woodland Court. 1 SECTION II. This Resolution shall take effect immediately upon passage by the City Council. PASSED AND APPROVED BY THE CITY COUNCIL AND MAYOR OF THE CITY OF KALISPELL THIS DAY OF 1996.
