6. City Vacating 50' of 13th Ave WestAGENDA ITEM 6 - CITY VACATING 50' OF 13TH AVENUE WEST -NORTH OF 7TH STREET WEST BACKGROUND/CONSIDERATION: As discussed at the Work Session, this action has been requested by the property owner. With the completion of the vacation, the property owner has agreed to pave 20 feet for use as an alley. The Public Works Department has researched and discussed this item with the property owner. RECOMMENDATION: The property owner and Public Works Department have agreed that the vacation and improvements are acceptable/desirable to both parties. I concur with the Director of Public Works' request and recommendation. ACTION REQUIRED: Action to begin vacation procedures can be done by instructing Staff to publish the required NOTICES. Upon expiration of the required notices, we will bring the issue to the Council for final approval. Mr. Roybal has agreed to pave the new twenty (20) feet alley along with dedicating four (4) feet additional land for the alley north of the vacation. Property owner Paul Roybal has been working with the department of public works to resolve this problem. The property owner has agreed to pave, maintain and improve the section of land.
