7. Addendum to North Side Water Well Engineering ContractAGENDA ITEM 7 - ADDENDUM TO •. SIDE WATER WELL ENGINEERING CONTRACT BACKGROUND/CONSIDERATION: This project contract dates back to April, 1994. The contract fees were negotiated for engineering services only through the test well and report phase. Final design and construction management phases were left for future negotiations. (NOW is the time for the future negotiations). The project will be built on the college property. We now have approval from the College President to drill the new wells during Christmas break and into the next semester. Public Works has negotiated a contract for the completion of this well project. RECOMMENDATION: Exhibit G is a report outlining the negotiated fees. To allow this project to progress on a timely basis, I concur with the negotiated fee and recommend approval of the contract with the new fees. ACTION REQUIRED: MOTION to approve the contract as negotiated is required. ADDENDUM A THE SPECIFIC SECTIONS AND ITEMS NOTED BELOW FROM THE NORTH SIDE WATER WELL ENGINEERING SERVICES AGREEMENT DATED MARCH 29, 1994 BY AND BETWEEN THE CITY OF KALISPELL, HEREINAFTER REFERRED TO AS OWNER, AND THOMAS, DEAN & HOSKINS, INC., HEREINAFTER REFERRED TO AS ENGINEER, ARE HEREBY MODIFIED AS FOLLOWS: •' " 1. Add the sentence, "Survey work will include the location of the tennis courts, irrigation lines and other features pertinent to the construction plans. All engineering work under this item shall be completed on or before September 15, 1996." 2. Scope of work completed. 3. Scope of work completed. 4. Scope of work completed. 5. Add the sentence, "Application preparation will also address the DNRC's requirement for the Owner to justify any new water right, including evaluation of all current water rights and projections up to 20 years into the future. All engineering work under this item shall be completed on or before October 1, 1996." 6. Delete the sentence, "The City will provide the computer modeling of the proposed improvements." Add the following sentences, "The Engineer will provide the computer modeling of the proposed improvements. Revisions from the preliminary report will include the modeling input, hardcopy of modeling output, and the Engineer's explanation of modeling results, additional well and aquifer studies and a revised site plan for the improvements. Analysis and recommendations for modifications to the existing SCADA telemetry system will be through subcontract to the Engineer by Casne Engineering and included in the Final Design Report. All engineering work under this item shall be completed on or before October 1,1996." 7. Add the following sentences, "The project will be bid as two projects with separate design and bid documents for well drilling and for the pumps, pump house, electrical, controls and necessary appurtenances. Modifications to the existing SCADA telemetry system will be included in the design for the pumphouse. Final design for both the well and pumphouse et.al. shall include architectural, structural, landscape, electrical, controls, auxiliary power generator, mechanical, site grading and all other appurtenances necessary for a complete project. Plans and specifications for the final design shall be submitted to the Department of Environmental Quality for review on or before October 15, 1996 for the well and November 15, 1996 for the pump house and appurtenances." 8. Remains in effect. 9. Remains in effect. PART I - ENGINEERING FEES All Thomas, Dean & Hoskins invoices for engineering services dated prior to February 15, 1996 have been paid in full. All invoices dated after February 15, 1996 will be paid in accordance with the following terms, in which the individual item numbers correspond to those of the original contract. Part II of the the original contract and the dollar amounts contained therein are no longer in effect. The Engineer will provide services as described in Part I and amended above for which the Owner shall compensate the Engineer in accordance with the following schedule. Fees for services provided by the Engineer will be billed at two times payroll plus out of pocket expenses at actual cost plus 10 percent. Mileage will be charged at the rate of $0.35 per mile. Fees for any and all sub -contractors are included in these estimates. The fee estimates are accepted as costs not to be exceeded. Invoices will be itemized according to these pay items and will include a description of the work completed. Payment for item 6 will be made upon acceptance of the Final Design Report and final cost estimates. 1. Preparation of the application to withdraw water, submittal to the DNRC and required follow-up responses to the DNRC will be provided for an estimated fee not to exceed $1200. 6. Final design report and cost estimates will be provided for an estimated fee not to exceed $8600. 7. Final well design, plans, specifications and bid documents will be provided for an estimated fee not to exceed $4000. Final design, plans, specifications and bid documents for piping, electrical, pump houses, controls, telemetry modifications, landscaping, access and miscellaneous improvements will be provided for an estimated fee not to exceed $32,600. 8. Construction management for the production well will be provided for an estimated fee not to exceed $6000. Construction management for the pump house, piping, electrical controls, telemetry modifications, landscaping, access and miscellaneous improvements, start up and operations and maintenance manual will be provided for an estimated fee not to exceed $26,000. 9. Warranty inspections, operator assistance and performance certification will be provided for an estimated fee not to exceed $1200.
