BE IT Ri],SOLVIM BY THE CITY COUNCIL OF =H,' CITY OF X-PiLISPiZL, MONTPITA: Section 1. W117.11EAS, the Public &nployees Retirement Act (Chapter 212 Session Laws of Montane, 1945) provides for the establishment of a Retirement Plan for employees of certain Public Agencies, and Section 2. the Board of Administration of the Public thployees Retirement System has adopted a Resolution providing for the participation in said System of Cities, Counties, School Dis- tricts and other public agencies under certain conditions as follows, "Any County, City, School District or other public agency may contract with the Board of Administration of this System whenever it shall be made to appear that 75% of the qualified members of such public agency have indicated by signing an 11�^1mployees Statement of employment Record (Pars-1) Card" and attached thereto a statement that they desire to participate in the 11atirement System as it is established by Chapter 212 of the Session Laws of 1945. The proper legislative body such as The Board of Commissioners, City Council, board of Trustees or other like nuthority shall there -upon adopt a resolution setting into affect such a contract. The contract thus effectuated shall be upon the terms and conditions, rates and other factors 99 they appear in the State Law. The employees affected will be required to pay the 41.00 membership fee and the, rates set forth in Regulation No. 2 and No. b as adopted by the Board. of Administration. The County, City, School District, or other Public Agency will be required,to pay the 3% State portion tax to the fund. The said contract will also provide tnat any amendment, to the law by the Stete Legislature shall likewise amend the contract existing with a Public Agency to the same extent." Section 3. 11FEMEAS, the employees of the City of Kalispell have expressed a desire to participate in said. Rptiren,,ent Plan, NOW T111�'RI:FOR E 13E IT 1?]SOUIEED that the City Council of the City of Kalispell, Montana hereby declares its intention to set up a Retire- nient Plan for its employees upon the identical terms, conditions, rights, privileges, and Plan provided by the Public =ployees _Rotire- ment Act to become effective July 1, 1946.
