Resolution 1734 - Authorize Excess ExpenditureRESOLUTION No. 1734 A RESOLUTION AUTHORIZING THE EXPENDITURE OF MONEY FOR DAMAGES AND JJ' J G IF'NTS NOT PROVIDED FOR -IN TM CURRENT TDGET. WHEREAS, one David Powers of Butte, Mntana, was accidentally in- jured when a pistol was discharged by a member of the city police force in performance of his duty, and WHEREAS, the said David Powers has executed a release freeing the City of Kalispell of all further claims and demands of every kind on his part for this injury upon the payment of $78.85 to the said David Powers and the payment of all charges and expenses of Dr. R. L. Towne and the Kalispell ('general Hospital, a sum of $41.00 additional, and WHEREAS, no provision was made in the current budget for expendi- tures of this nature, therefore BE IT RESOLVED by the City Council of the City of Kalispell,that by reason of the facts as hereinbefore stated an emergency is hereby declared to exist under the provisions of the second para- graph of Section 8 of Chapter 121 of the Laws of the Twenty-second Legislative Assembly of the State of Montana, and that the City Clerk be and he is hereby authorized to draw emergency warrants against the General Fund of the City of Kalispell and the City Treasurer is authorized and directed to pay such warrants with any money in such fund available for such purpose and if there shall not be sufficient funds in said fund, then the said warrants shall be registered, bear interest and be called for payment in the manner provided by law as for other city warrants. This being an emergency resolution as herein set forth, the same shall take effect and be in full force and effect immediately upon its passage and approval.
