09. Resolution 4268 - Woodland Court Change OrderRESOLUTION NO. 4268 A RESOLUTION TO ALTER AND AMEND THE PLANS AND SPECIFICATIONS OF CONTRACT WITH PACK & COMPANY ON THE WOODLAND COURT PROJECT. WHEREAS, the City on November 14, 1995 did enter into a contract with Pack & Company of 2335 Highway 93 North, Kalispell, Montana for construction of the Woodland Court project, and WHEREAS, upon the advice and recommendation of Fred Phillips, who is the City's consultant on said project, certain changes and alterations of design and specifications have been found necessary and advisable and in the best interests of the City; and said changes and alterations could not have been necessarily foreseeable when the original design and specifications were prepared on this phase of the construction of the Woodland Court project, and said changes are contained in Exhibit "A", attached hereto and are by this reference made a part hereof; and WHEREAS, it appears in the best interests of the City to approve said changes and alterations, NOW THEREFORE, pursuant to the provisions of Section 7-5- 4308(1) MCA be it hereby resolved: 1. The alterations and modifications of the specifications {. and plans of the contract between the City of Kalispell and Pack & Company, dated April 30, 1996, as set out in Exhibit "A" attached hereto are hereby approved, and 2. As soon as the price to be paid for said alterations and modifications are agreed to in writing, signed by the contractor, as hereby approved by the Council, this approval thereof shall be in effect. (NUPAC) The following changes are hereby made to the CONTRACT DOCUMENTS: 1. Change contract to a "Working Day Contract" for period 3/16/96 through the end of contract. Working days shall be defined as any day on which site conditions allow proceeding with the remaining work on the project. Justification: The contract reverted from a working day contract to a calendar day contract on 3/16/96. The Engineer has stopped work on the project due to soil conditions. The Contractor has completed work when conditions allow. The contract time will be based on the actual days worked. Days on which conditions allow work to proceed that the Contractor chooses not to work wdl be counted against contract time. 2. Add "Connect Existing Water Service" to the contract. Justification: The water services were encountered on the South Woodland water main which were not located as part of utility locates and not shown on the plans. The Contractor was required to provide temporary water service as part of the contract. New connections constitute additional work. Cost of connecting existing services is based on hourly labor rates as specified in the contract, hourly equipment rates, invoiced material costs, and markup for allowable overhead and profit. ORDER NO. 2 DATE:-____-- Afflft AGREEMENT DATE:_ 11/14/L5 The cost for co4necting existing services is outlined in Exhibit A. The contract time is extended 1 days for -the water main adjustment work. The cost for connecting existing services is $1,168.01. 3. Add "Adjust Water Main" to the contract. Justification The separation between the new sewer main and existing Green Acres Water System water main on Haven Drive and South Woodland was less than 12". The water main adjustment was required to provide separation in accordance with MDEQ regulations for water and sewer mains. Cost of the water main adjustment is based on hourly labor rates as specified in the contract, hourly equipment rates, invoiced material costs, and markup for allowable overhead and profit. The cost for the water crossing is outlined in Exhibit B. The contract time is extended 2 days for the water main adjustment work. Total cost for the water crossing is $8,261.11. 4. Add "Asphalt Pavement Replacement" to the Schedule I & II contract. Justification: Asphalt pavement replacement for private driveways was not included in the contract for Schedule I and H. Asphalt pavement replacement for street crossings is moved from Schedule III to Schedule I & II and quantities increased so work can be completed as soon as conditions permit. Estimated asphalt replacement is 500 square yards. Contract price for asphalt replacement is $10.00 per square yard. The impact to the project is as follows: 1. No change. 2. $1,168.01 additional. 3. $8,261.11 additional. 4. Creates a $470 decrease in contract costs. The paving originally was included in A-1's paving bid. The total impact on the project is $9,429 and will have to be covered through the remaining contingency amount of $879 and the remaining amount taken from the landscapping budget for the homeowners. Please have the change order returned to us after signature. We will see to it that it is sent back through channels and distributed to the proper parties. Box 1997 Kalispell, MT 59903-1997 RE: Woodland Court Subdivision Schedule I & II Dear Susan: MAY 1 5 1996 Enclosed is pay estimate #5 and Change Order #2 for the referenced project. The change order includes the following items. 1. Changing the contract back to a working day contract retroactive to March 15, 1996. Work progressed on a working day contract prior to March 15. This was approved to allow work through the winter as weather allowed. The contract was to change to a calendar contract on March 15. Work stopped on the project due to severe conditions after March 15. Approval of a working day contract will not change completion of the job within the contract time. The change is to allow contract time based on the number of days worked. 2. Three water services were located on South Woodland Drive where the main was replaced. No services were known to exist based on the utility locations. The contractor was required to maintain temporary service to the services during construction. Connection of the existing services was completed after the main was installed and tested. The reconnection is additional work. 3. A water main adjustment was required for the water main at Haven Drive and South Woodland Drive. The main is part of the Green Acres system. The information from Green Acres indicated a separation of 12" from the existing 6" water main and the new sewer main. MDEQ allows deviations for separations down to 12" and at times 611. The actual separation was less than 3", therefore a water main relocation was necessary. 0 OFFICES IN GREAT FALLS. BOZEMAN, KALISPELL. SPOKANE AND LEWISTON ACEC Susan Moyer 5-14-96 Page 2 The crossing was completed by raising the water main 18" above the sewer main. The work was completed with payment on a time and materials basis. The cost is $8,261.11 and includes $2,587.50 for non - shrink backfill in the county road plus miscellaneous items of construction. 4. Moving asphalt replacement from schedule III to Schedule I and II and increasing quantities to cover actual pavement replaced will allow completion of pavement replacement as soon as conditions permit. The change to Schedule I and II will save $470 in pavement replacement costs for street crossings. Additional cost in Schedule I and II is $5000 which work includes all street and driveway pavements replacement. Please contact us if you have any questions.
