Kalispell, MT 59901 (406)755.8707 FAX (406) 755.2613 The above mentioned resolutions were in favor of our clients for the approval of their respective major subdivision. The preliminary plats were approved for one year, a departure from state statue of three years with a one year right of extension. We have exceeded the one year period on both subdivisions and respectively request that the Council grant a retroactive extension to enable our clients to complete the specified improvements and file the final plat. State statute allows for this. Sunrise• View Subdivision is approximately 80% complete with curbing, paving and street lights to be installed when weather permits. Frank's Place Subdivision has the lots pinned and natural gas has been extended to each lot. Habitat for Humanity is currently negotiating to purchase one or mre of the lots, which will necessitate the improvements to be completed and the final plat filed. Traditionally the City has not provided the developer or their agents with the resolution or specific conditions found therein. We would find it extremely beneficial if the City would adopt a policy of: 1). Granting preliminary plats to be effective for three years with a one year extension right. 2). Provide the developer with the appropriate resolution in a timely manner. 3). Provide 30 day notice before expiration. Page 2 We realize that the aforementioned request would place an additional burden on the city; however, the Council would not be plagued with annual extension requests.
