Dear Bruce:
Our office has received the application for final plat approval of the Amended Plat of the East
1/2 of Lot 3, Block 38, Kalispell Original. This property is in a B-4 zoning district and is
located on the west side of Third Avenue East between Center Street and First Street
north of Linderman School approximately 200 feet. The parent lot contains approximately 3,572
square feet (0.082 acres) with a total of 50 feet of frontage on Third Avenue East. Lot 1 will
contain approximately 2,009 square feet and Lot 2 will contain approximately 1,544 square feet.
There is currently a residence on each of the lots.
This property is described as the East 1/2 of Lot 3, Block 38, Kalispell Original located in the
SW4 of the SW4 of Section 8, Township 28 North, Range 21 West, P.M.M., Flathead,
Montana.
Preliminary plat approval was granted by the City Council on May 1, 1995 by way of Resolution
4206 subject to five conditions of approval. The following is a list of the conditions of approval
and a discussion of how they have been met.
COMPLIANCE WITH CONDITIONS OF APPROVAL
Condition #1
Comply with the City of Kalispell's Building Code.
This condition has been met. The property boundary has been adjusted to address
the Building Departments' concerns regarding the required setbacks between the
two existing residences.
Condition #2
Create easements and obtain approval from the respective utility companies.
Utility and walkway easements along the common property boundary have been
shown on the final plat. An easement agreement dated August 29, 1995 has been

executed between the property owners of the proposed subdivision and the
property owners of the West 1/2 of Lot 3, Block 38, Kalispell Original.
Condition #3
Obtain approval from the City's Public Works Department for sewer and water connections.
This condition has been met. The Public Works Department has reviewed the water and
sewer connections as part of the Department of Environmental Quality review process.
No further easements or connections are required at this time.
Condition #4
The plat shall be approved by the Department of Environmental Quality.
This condition has been met. A letter from the Department of Environmental
Quality, Water Quality Division, E.S.#15-95-S358-1162, dated May 23, 1995
approves the filing of the final plat because this property is in a master planned
area and is served by community water and sewer.
Condition #5
That this preliminary plat shall be effective for one year.
This condition has been met. The final plat has been submitted prior to the expiration
date of May 1, 1996.
COMPLIANCE WITH APPROVED PRELIMINARY PLAT
The final plat is in substantial compliance with the preliminary plat which was submitted and
approved.
COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in substantial compliance with the State and City
Subdivision Regulations.

RECOMMENDATION:
All of the conditions of preliminary plat approval have been adequately met or otherwise
addressed. The Flathead Regional Development Office recommends that the Kalispell City
Council approve the final plat for the Amended Plat of the East 1/2 of Lot 3, Block 38, Kalispell
Original.
