In December, we had 50 non jury trials and conducted pretrials for jury trials in 83 cases. Three cases were actually tried. In January, we have 36 non jury trials scheduled, 93 pretrials and 6 days set aside for jury trials. We also have 11 parking ticket cases set. Two cases were set for appeal in District Court during the January term, but one was settled on December 27th, so we have only one District Court trial on January 8th. 2) This office has completed revisions of the Kalispell City Code in the following areas: Administration (Chapter 2), Alcoholic Beverages (Chapter 3), Animals and Fowl (Chapter 4), and Motor Vehicles and Traffic (Chapter 17). We can have proofed copies of Ordinances to the Council whenever they would like to begin review of the changes. Subdivision Regulations are being redone by FRDO and will be available sometime it the Spring of 1996. Several other chapters will not need extensive revision because of recently enacted amendments. Within the next few days I will begin revising the Police, Fire and Offenses portions of the Code. I anticipate that we will have all revisions accomplished and be ready to go to the printers in April of 1996. 3) This office is preparing to deal with the Evergreen Sewer issue at the direction of the Council. We have reviewed the report issued by Tim Berry at Morrison and Maierle. Recent contacts with representatives of Evergreen indicated that their accountant was examining the Berry report and would be giving them his analysis in early January. Berry's report to a great extent gives us the tools, and we need to implement a program which will properly compensate the City for its efforts.
