."HEREAS, the State Highway proposes to purchase a tract of land
in the NWJSwr� of Section 8, Twp. 28 N. Range 21 West, including
what would be. if extended, Sixth Avenue Nast North, from the
north boundary of the Kalispell Lumber Company tracts to the
north boundary of the Great Northern R-,iilway right of way, pro-
viding a clear title can be secured thereto, and
AYTIEREAS, the City of Kalispell owns an easement along the north
boundary of said Great Northern right of way, -which easement
was used in connection with the ori.ginal water plant now aban-
doned, and
,7111BREAS, Mayor 13ruckhauser, after causing due and careful in-
vestigation, found no purpose or probable use of the said ease-
ment by the City of Kalispell. 4`Ihereupon he executed a Qutt Clain
Deed thereto on November 19, 193b, duly -attested, by the City Clerk
and 3uperintendent of the 47ater Department; therefore
RE, IT RESOLVED that this Council do herebly ratify and confirm
said action of the City OfC'icials in the execration of said Quit
Claim Deed.
Passed by the Council of the City of Kalispell, lUontana, and
approved by the "ayor on the wand day of December, 193,15.
