The above -referenced application has been reviewed for final plat approval. The 27-lot
residential development is located west of Airport Road, north of South Meadows
Subdivision, and south and southwest of Ashley Creek. Belmar Addition was annexed
and received preliminary plat approval on May 17, 1995. This report evaluates
compliance of the final plat with the conditions of preliminary plat approval and
applicable city and state regulations. City Council approved the subdivision subject to
15 conditions of approval.
COMPLIANCE WITH CONDITIONS OF APPROVAL:
1. The development of this subdivision comply with the R-4 standards set forth in
the City of Kalispell Zoning Ordinance.
The subdivision complies with the R-4 standards set forth in the Kalispell Zoning
Ordinance. This condition has been met.
2. That the subdivision obtain approval from the State Department of Health and
Environmental Sciences.
The State DHES letters of approval have been submitted and are attached. This
condition has been met.
3. All water lines, sanitary sewer, culverts, and storm sewer lines/swales shall be
built according to plans and specifications approved by the City of Kalispell
Public Works Department. All water, sewer main extensions, and storm sewer
lines/swales on private property shall be placed within suitable easements and
approved by the City of Kalispell Public Works Department.
Public works has approved the required plans and are satisfied with the specifications
of those plans. Water, sewer main extensions have been installed and a north/south
12 foot drainage/access easement is located along the westerly boundary of Lot 11.
This condition has been met.
4. The construction of the street shall include in a 60 foot right-of-way: 36 foot back
of curb to back of curb street improvements, sidewalk on the outside of the loop

including both sides of what was Lot 57 South Meadows and the west line of Lot
21, and street trees planted in compliance with City of Kalispell standards.
The Public Works Department has indicated that the improvements have been
constructed in accordance with this Condition. The street trees have not been installed
in a conversation with Mike Baker, Director of Parks, he indicated that street trees
would be installed at the time of development of the individual lot and is satisfied that
Dennis Carver would install said trees at that time. This condition has been met.
5. All utilities shall be installed underground.
Utilities have been installed underground. This condition has been met.
6. The owner shall pay a cash -in -lieu of parkland payment equal to 1/9 of the
undeveloped market value.
Cash -in -lieu fee has been attached in the amount of $2,393. This condition has been
met.
7. Placement of fire hydrants shall be approved by the City of Kalispell Fire
Department.
A letter from Ted Wagner, Fire Chief indicates that fire hydrants and flows are
approved. This condition has been met.
8. All roads within the subdivision shall be finished (i.e., paved) to City of Kalispell
standards.
As of the writing of this report the roads were in the process of being paved. This
condition has been met.
9. Lot numbers, street addresses, and net acreage for each lot shall be included on
the face of the final plat.
These are indicated on the face of the Final Plat. This condition has been met.
10. Documentation from the Chief of the Kalispell Fire Department which indicates
that the proposed fire suppression facilities are adequate, shall be submitted with
the application for final plat approval.
A letter from Ted Wagner, Fire Chief indicates that fire hydrants and flows are
approved. This condition has been met.

11. All streets shall be clearly signed in a manner conforming to City standards.
As of the writing of this report, the sign has been purchased and Dennis Carver is
waiting for delivery. This condition has been met.
12. Label the remaining portion of Parcel 1 K as "not a part".
This has been done on the final plat. This condition has been met.
13. Indicate the 100 year floodplain on the final plat.
This has been indicated on the final plat. This condition has been met.
14. That a 30 foot setback from the high water mark of Ashley Creek be established,
protected and maintained with native vegetation.
The 30 foot setback has been established on the final plat. This condition has been
met.
15. This preliminary plat approval is valid for a period of one year. A one (1) year
extension may be granted by Council.
The final plat has been submitted within this time frame. This condition has been met.
COMPLIANCE WITH THE APPROVED PRELIMINARY PLAT
There are no significant changes to the preliminary plat other than those required for
Final Plat compliance.
COMPLIANCE WITH SUBDIVISION REGULATIONS
The Final Plat is found to be in substantial compliance with the Kalispell City
Subdivision Regulations and Montana Subdivision and Platting Act.
It is recommended that the Final Plat of Belmar Addition be approved as submitted.
The City has 30 days from date of receipt of this report to complete final review. If you
