10. Resolution 4215 - Authorize Purchase of PropertyRESOLUTION NO. 4215 A RESOLUTION AUTHORIZING THE PURCHASE OF LOT 6, PORTA VILLA SUBDIVISION, FROM AECS LTD. AND AUTHORIZING THE CITY MANAGER TO ACCEPT SAID PROPERTY ON BEHALF OF THE CITY OF KALISPELL. WHEREAS, the City of Kalispell has the authority, pursuant to Section 7-1-4124, MCA to buy any interest in real or personal property, and WHEREAS, the City is in receipt of a Home Investment Partnerships Program (HOME) Grant for the creation of a first time home buyer program through the Department of Commerce, State of Montana, and WHEREAS, the City intends to utilize proceeds of the HOME Grant to finance the purchase of vacant property for the development of housing opportunities for very low to moderate income individuals, and WHEREAS, on May 14 and 21, 1995, the City advertised in the Daily Inter Lake a request for proposals for land upon which to construct, pursuant to the HOME Grant, 22 to 24 first home buyer duplexes, and WHEREAS, AECS Ltd., 2440 Sanborn Drive, Sedona, Arizona, owns Lot 6, Porta Villa Subdivision #3, Kalispell, Flathead County, Montana, and has offered to sell ._ said real property to the City for the sum of $142,875.00, and WHEREAS, the City Council, after reviewing the offer made by AECS Ltd., deems it appropriate, pursuant to Section 7-1-4124, MCA, and in the best interest of the City of Kalispell, that the City accept the offer made by AECS Ltd. and purchase said real property for the purpose of developing housing opportunities for very low to moderate income individuals. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION I. That the City Manager is authorized and directed to purchase from AECS Ltd., Lot 6, Porta Villa #3, Kalispell, Flathead County, Montana; for the sum of One Hundred Forty-two Thousand Eight Hundred and Seventy-five Dollars ($142,875.00). 1 SECTION II. That the City Finance Director is authorized and directed to pay in accordance with the instructions from AECS Ltd., the sum of One Hundred Forty-two Thousand Eight Hundred and Seventy-five Dollars ($142,875.00) with funds properly appropriated from the HOME Grant received by the City of Kalispell. SECTION III. That the City Attorney is authorized and directed to prepare any documents necessary to effect this Resolution and the City Manager is authorized and directed to accept and properly record on behalf of the City the deed to said property. SECTION IV. This Resolution shall take effect 30 days from and after its final passage by the City Council.
