Resolution 1481 - Emergency - Payment of Pipe InvoiceRESOLUTION No. 1481. A RESOLUTION DECLARING THAT AN 7ZMEGENCY EXISTS, AND TMIT IT IS NECESSARY TO MAKE EXPENDITURES IN EXCESS OF THE AMCUY.? PROVIDED FOR BY THE' CU_�RENT BUDGET FOR TIM PAYMENT OF PIPE USED IN THE INSTALLATION OF A DRAIN ON THE COURSE OF SPRING CREEK. BE IT RESOLVED 'BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTAhAt WHEREAS, the City of Kalispell has through the Relief Adminis- tration of the Onited -btates obtained certain funds for the purpose of filling in the course of opring Creek, the waters of which have heretofore been diverted, and for the laying of a drain along the course thereof, and for the purpose of completing such im- provement, it has been necessary for the City of Kalispell to purchase five thousand feet of eight and ten inch sewer pipe, and incur other expenses at a cost of approximately 42500.00; and WHEREAS, said work was commenced for the purpose of giving relief to the unemployed in and about the City of Kalispell, and it was further necessary for the preservation of the public health of the people of Kalispell to lay said drain, and that it is proper and within the law to issue emergency warrants over and above the amount provided for in the annual budget of the City of Kalispell for the purpose aforesaid; BE, IT RESOLVED by the City Council of the City of Kalispell that by reason of the facts as hereinbefore stated that an emer- geney is hereby declared to exist under the provisions of the second paragraph of Section 8 of Chapter 121 of the Laws of the Twenty-second Legilative Assembly of the itate of 1,11ontana, and that expenditures in, the excess of the current budget of the City of Kalispell be exceeded in the sum of 2500.00 for the purposes hereinbefore set forth, and that emergency warrants be drawn againSt the General ieund of the City of Kalispell, and that the City 'Treasurer Is authorized and directed to pay such warrants with any money in such fund available for such purpose, and if there shall not be sufficient funds in said Fund, then the said war- rants shall be registered, bear interest and called for payment in the manner provided by law as for other city warrants. `Phis being an emergency resolution as herein set forth, the same shall take effect and be in full force and effect immediate- ly upon its passage and approval. 'I'he foregoing iiesolution unanimously adopted by a majority of all of the members present at a meeting of the City council of the City of Kalispell, Montana, held on the 21st day of May,1935.
