A RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRICT
NO. 341 .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA:
SECTION I. That it is the intention of the City Council of
the City of Kalispell, Montana, to create Special Improvement
District No. 341 for the property described in Exhibit "A"
attached hereto and by this reference made a part hereof.
SECTION II. That the general character and nature of the
proposed Special Improvement District is to totally fund a
sanitary sewer main with services to the property line, and
optional service connection to individual dwellings, on Fifth
Avenue East beginning at Fourteenth Street East and continuing
South to the City Limits line.
SECTION III. That the District share the estimated cost of
said improvement which is One Hundred and Forty -One Thousand
Dollars ($141,000.00).
SECTION IV. That it is the intention of the City Council to
charge the expenses of the work for improvements to lots not
fronting on the above named avenue, as well as lots abutting
the improvement because the lots not fronting on improvement
are benefited by the improvement and the installation of a
sewer line in the area is of more than local or ordinary
benefit.
SECTION V. That the entire cost and expense of said
improvement shall be assessed against all of the property
within the district as follows:
A) One -hundred per cent (100%) of the
District's cost of construction and installing
the sanitary sewer, with services to the
property line, shall be assessed by
determining the lots fronting upon the
improvement and assessing each lot as its
frontage bears to its proportion of the whole
cost of the improvement. Lots not fronting
shall be assessed based upon an average
fronting of those lots fronting the
improvement.
B) The cost of constructing and installing
service connections to the individual
dwellings shall be assessed based upon the bid
price in the improvement district contract and

assessed only against the lots, tracts and
parcels of land served by the utility service
connections.
SECTION VI. That said assessment shall be paid for in full
upon completion of the contract, or shall be paid in thirty
(30) equal semi-annual installments, extended over a period of
fifteen (15) years. Said assessments shall constitute a fund
to be known as Special Improvement District No. 341.
SECTION VII. That said improvement shall be paid for in
Special Improvement District Bonds issued against said
District in sums not to exceed Five Thousand Dollars
($5,000.00) each, bearing interest at a rate that is no
greater than allowed by the laws of the State of Montana from
the date of registration until called for redemption or paid
in full.
SECTION VIII. That on the day of ,
19 , at 7 :00 P.M., in the City Council Chambers of City Hall
in the City of Kalispell, Montana, at a regular meeting
thereof, the City Council will hear and pass on any protests
that may be made against the making of said improvements or
the creation of said District.
SECTION IX. The Clerk of Council is hereby authorized and
directed to give proper notice of the passage of this
Resolution by publication and mailing as required by law, such
publication to be made in a daily newspaper published in the
City of Kalispell, Montana.

FIFTH AVENUE EAST SANITARY SEWER SID
The boundaries of the Fifth Avenue East Sewer Project extend from Fourteenth Street to the
South City Limits. There are 34 individual properties within the district. Despite a number of
efforts we have not been able to persuade any adjacent property owners to annex and join the district.
The cost of the project, including construction, engineering and bonding expenses has been estimated
at $141,000. An informational meeting was held the evening of March 30th at City Hall with the
residents of the district. The meeting was well attended. Following the presentation by City Staff
a question and answer session was conducted. The atmosphere of the meeting was positive
throughout. A timetable for the project is attached.
