WORK SESSION AGENDA MEMO

Re: Work Session Agenda April 10, 1995
We have developed a preliminary work agenda for your April loth
Work Session. As I thought, most of the planning items on this
agenda will not include Planning Board minutes or transmittal
letters from the planning office. This information should be
available for your review Monday evening.
Agenda Item 4 - Birk Subdivision - I have included in your packet
the background information concerning Tim Birk's subdivision, which
was considered by the Planning Board on March 14th. As you know,
Mr. Birk requested the annexation and an initial zone of R-4 for a
12 acre parcel of property located on the east side of Hathaway
Lane, 1300 feet north of Idaho Street, southwest of the Greenbriar
subdivision. The applicant also requested the preliminary plat
approval of a 50 lot residential subdivision for this tract of
land. I have included the FRDO Staff report on both requests,
which are the only documents available for distribution at this
time. The Planning Board is recommending denial of both requests.
It is my understanding that Mr. Birk is still interested in
pursuing the annexation and zone designation, with a modified
phased subdivision that provides for reservation of right of way
for the alternate route 93.
Agenda Item 5 - Belmar Annexation and Preliminary Plat - Public
Hearing. Dennis Carver has requested annexation and zoning classi-
fication of R-4 for a 7 acre parcel of property located north of
the South Meadows subdivision. The applicant has also requested
preliminary plat approval for a 27 lot single family/duplex
subdivision to be known as Belmar. The Planning Board is
recommending approval of both requests. Your packet includes the
FRDO background material and the minutes of the February 14th
Planning Board meeting. A public hearing has been scheduled for
your meeting of April 17th.
Agenda Item 5 - Resolution of Intent to Create an SID - Your packet
contains a copy of a resolution of intent to create the 5th Avenue
East Sewer Special Improvement District. We have held a
neighborhood meeting concerning the SID, which was very well
attended. It appears that a large majority of the property owners
of the proposed district favor the project. A memo from Public
Works highlights the status of the project.
Agenda Item 7 - Zoning Text Amendment - Included in your packet is
a memo from John Parsons concerning the City's request to amend the
RA-2 intent section of the zoning ordinance. As you will recall,
staff was directed to have the following language deleted:

"This district is intended for central and inner-city use and not
for suburban use." And to add the language: "to serve as a buffer
between commercial and suburban residential zones." Although we do
not have the Planning Board's minutes from the meeting, they did
not recommend the change as proposed by staff. We should have the
Planning Board minutes and FRDO transmittal letter for Monday
evening work session.
Agenda Item 8 - Jake Brake Ordinance - Some months ago I was asked
by Councilman Nystul if the staff had been receiving complaints
from city residents about large trucks using their air compression
brakes as they enter town, particularly those entering from the
north on Highway 93. I mentioned that in fact we have gotten a few
complaints from folks living around North Meridian and Buffalo Hill
Terrace about the loud noise made by the use of jake brakes. Gary
asked if we would draft an ordinance which would prohibit the use
of such braking devices inside the city limits of Kalispell. Your
packet contains the proposed jake brake noise ordinance.
Agenda Item 9 - Phase II High School Parking Lot - Bruce Lutz is
about to begin the design phase for the second part of the High
School parking lot. Before he begins, we would like Council feed
back concerning the construction of sidewalks in and around the
project. We have included a map of the project showing the areas
that have no sidewalks with a cost estimate to install them. We
need to know which sidewalk sections you want included in the
project.
Agenda Item 10 - Extension of Services Plan - Time permitting, we
would like City Council to work through the policy section of the
manual. It would be my intent to address each individually so, if
possible, have your thoughts ready for Monday evening. The
Extension of Services Plan was passed out to you a couple of weeks
ago.
Agenda Item 11 - Airport - I was not certain if you intended to
discuss the result of our public meeting concerning the airport, so
we may want to reserve some time to do so.
Agenda Item 12 - Public Hearing -Northwest Health Care PUD - We do
not have any information from the planning office on this topic as
yet, but we do have a statutory requirement to schedule a public
hearing within 60 days. We therefore will request authority to do
so Monday evening.
Agenda Item 13 - Public Hearing -Gateway Orchard Villas -Preliminary
Plat - Inlcuded in the packet is the FRDO Staff report recommending
approval of the preliminary plat. The Planning Board also
recommended approval, you will receive that transmittal report with
the minutes on Monday.
