The first step in the procedure will be to recommend to Council an ordinance or series of ordinances repealing certain parts of the Code. So far the list of repealing Ordinances include several sections under animals and fowl, fire zones, Firemen's disability and pension funds, all licensing ordinances, and several sections in the offense portion of the code. Many sections of the existing Code have been supplanted by State law or are archaic. I anticipate that within the next 60 days the Council will be receiving a list of sections needing repealed. Once the repealing ordinances are adopted by the Council, we will publish an updated Code and begin the process of amending sections to conform to State law and the modern needs of the City. After discussing the matter in house and investigating publishing companies that offer codification assistance, I determined that the City would receive a better product, at less cost, by doing the work in house. 2) I believe that the Council was informed at the January 23 workshop that the City staff had recalculated the Evergreen sewer rate for 1995. Based upon actual costs and actual flows over the last 6 months Evergreen Water and Sewer owes the City $16,859.63 for treatment since July 1994. The new rate calculation works out to be $1.81 per thousand gallons. I believe the basic calculations and letter from Amy Robertson to Evergreen is included in the Council packets for this week. 3) As I indicated in a previous memo to you the Council, the City and Swank were involved in a dispute over the amount of sewer/water connection fees on the Courtyard Apartment project. Duane Larson Ward IV Bruce Williams February 3, 1995 Page 2 After several telephone conversations with Swank's attorney, I indicated that I didn't think that Swank had a very strong case demanding a change order based upon his accounting; however, I further indicated that it would probably cost the City $1, 500.00 to arbitrate the matter and offered that amount to settle the dispute. On January 25, I sent a letter to Swank's attorney offering the amount in settlement. The next day Swank countered with a $2,000.00 figure. I determined that it was probably in the City's interest to settle on the $2,000.00 and advised Swank to submit a claim. You will find in the claims this week a letter from Jane Mitchell, Attorney for Swank, requesting $2,000.00. 4 ) I have had a couple of phone conversations with people who are concerned about the current situation at the Kalispell City Golf Course. One individual called threatening a lawsuit if the City required the Golf Association to tier the membership. I informed this individual that although I had not researched the matter, I could not say that a tiered rate at the Golf Course would be held to be illegal discrimination, thereby threatening the Association's tax-free status. From a subsequent conversation with Marshall Murray, it is my understanding that the Association's decision not to tier the rate is not based on the illegality of a tiered rate but on the fact that a tiered rate may require the Association to refile for tax-exempt status, and the Association's past financial condition may lead to a denial by the IRS. 5) On Thursday, February 2, Bruce and I had a lengthy conversation with Bill Boharski regarding the legislation (SB 52) presented by John Harp. I am sure Bruce will brief the Council more fully than I can here but I believe the chances of SB 52, as well as some other legislation regarding annexation, passing is good. It is unfortunate that legislation affecting all cities in Montana in the future has been offered to resolve a local dispute. Whether or not members of the Council agree with the annexation of the Evergreen Strip, I believe we should all question the exercise of legislative power to settle a provincial controversy. 6) During the month of January, this office conducted 65 pre - trials, 26 non -jury trials and one jury trial in City Court. Not only were permits issued for six new single family homes but work continued on other residential, multi -family and commercial projects. With the cooperation of the weather there is a lot of construction going on and a lot of support is being provided by the Building Department. Zoning: Due to lack of applications, no Board of Adjustment meeting was held in January. Four sign permits were issued during this month. The zoning administrator concentrated his time on the Extension of Services Plan during January. Personnel: Joel Scallen will be leaving the building department sometime in February. Joel was hired as a temporary inspector and had previously worked in the county building department. His replacement, Mr. Rick Cockrell, has been hired. Rick is a Certified Building Inspector and also previously worked in the county building department. General: Annette spent a great deal of time collecting and processing prepaid sewer connection fees. Although the rush to beat the deadline for the fee increase has ended, I am still hopeful that the public works will assume responsibility for calculation and collection of their fees. Bruce Williams, City Manager Doug Rauthe, Mayor City Council Members The Kalispell Fire Department responded to 13 fire calls for the month of January 1995. One of the fire calls was a "General Alarm", a fire large enough to call in all off -duty firefighters. The "General Alarm" fire was a garage fire on January 29th, located at 310 4th A.E.. The fire started after the owner had just started the wood stove in the garage and some sparks from the stove ignited some dried flower arrangements stored near the stove. The fire did extensive damage to the garage and storage in the garage. There was also a vehicle in the garage that was completely destroyed. The Ambulances made 137 runs for the month of January 1995. MVA'S 11 Medical Emergencies 25 Cardiac 21 Sick Calls 23 Transfers 17 Trauma -Assaults 4 Falls 21 Strokes 4 Poisons 0 Psychiatric Problems 2 O.B.Patients 0 Drug -Alcohol 8 All of our fire department personnel received our annual Cardiopulmonary Resuscitation Course from our four firefighters that are certified to teach C.P.R. Two of our personnel, James Neal and Byron Guy attended a three day course on Advanced Pre -Hospital Trauma Life Support. This was a very intensive course on.the proper handling of trauma patients. Eight of our personnel az Technicians Paramedic Course. will enable our personnel to and intubations. There will portion ofthe course, with e< training. At the end of this a written and practical test. e starting the Emergency Medical This is a very intense course that give medications along with the IV'S be a didactic portion and clinical tch portion being about 300 hours of course each student will have to pass -2- There were 37 people that used the "Kalispell Firefighter's Chimney Brush Program", this period. The Kalispell Firefighters (no tax payer money), bought the brushes and rods to be loaned to any one who needs to clean their chimney. There were two groups of Cub Scouts that toured the fire station during Janaury 1995. A total of 17 students and 5 adults participated in the tours. Respectfully Submitted, Ted A.
