nursing home, on the property described above.
The Kalispell City -County Planning Board and Zoning
Commission, after due and proper notice, on January loth, 1995 held
a public hearing on the application, took public comment and
recommended that the application be approved subject to seven (7)
conditions.
After reviewing the application, the record, the FRDO report,
and after duly considering the matter, the City Council of the City
of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Flathead Regional Development Office, Conditional Use Report
#KCU-94-20 as the Council's findings of fact, and issues and grants
to the above -described real property a conditional use permit to
construct an addition to the existing Heritage Place subject to the
following conditions:
SECTION I.
1. Development of the site shall be in substantial
conformance with the submitted site plan and conditions
of approval.
2. A final Site Plan indicating the necessary modifications
be submitted to the Site Plan Review Committee for their
approval.
3. The proposed parking lots and access areas shall be
designed in accordance with Chapter 27.26 of the
Kalispell City Zoning Ordinance.
4. The southwestern access from Heritage Way to the driveway
be paved to City standards.
5. The water main, currently located beneath the proposed
addition, must be relocated prior to the issuance of a
building permit.
6. Prior to receiving a building permit, this project shall
comply with all related provisions and requirements as
presented by the Kalispell Site Plan Review Committee.
SECTION II.
The conditional use permit, herein granted, shall terminate 18
months from date of issuance if commencement of the authorized
activity has not begun.

The Kalispell City -County Planning Board and Zoning Commission met in regular
session on Tuesday, January 10, 1995 and held a public hearing on the following:
A request by Ron Gersack on behalf of Lantis Enterprises for a
conditional use permit in the H-1 zone to construct an addition to the
north side of the Heritage Place Extended Care Facility in Kalispell. The
expansion would include a dining room, activity area, and nurses, station
for specialized care. The property is described as Lot 1 of Heritage
Place Subdivision and is located on the north side of Heritage Way
approximately 400 feet east of Highway 93. The property is described
as Lot 1 of Heritage Place in Section 6, Township 28 North, Range 21
West, P.M.M., Flathead County, Montana.
John Parsons, of FRDO presented the staff report, and recommended granting the
permit subject to seven (7) conditions. The representative for Lantis Enterprises
explained the project, and asked for clarification on the recommended requirements.
No one spoke in opposition.
Following public input, the Board discussed the parking requirements, and
questioned the building permit acquired for the foundation prior to granting of the
conditional use permit. After modifying the conditions of approval, included as
Attachment A, the Board adopted the findings of fact, and voted 8-0 to recommend
granting the conditional use permit.
This recommendation is being forwarded to the City Council for final action. Council
needs to wait for the minutes to the Planning Board meeting prior to taking final
action on this case. However, this does not preclude Council discussion at its
workshop. If you have any questions regarding this request, please contact the

The site contains approximately 5 acres and is located on the north side of Heritage
Way approximately 400 feet east of US Highway 93, on the northwest corner of
Windward Way and Heritage Way. The property is described as a Lot 1 of Heritage
Place in Section 6, Township 28 North, Range 21 West, P.M.M., Flathead County.
C. NATURE OF REQUEST
The applicant is requesting a Conditional Use Permit to allow the construction of a
900 square foot addition to the 46,000 square foot existing facility. This expansion
would be to the north wing and include a nurses station and a dining/activity area
for the special care unit of the facility. The addition is a one-story design and
maintains the character of the existing facility.
The property currently is occupied by the existing center and is zoned H-1, Health
Care. Facilities such as this are allowed as conditional uses. The existing facility was
constructed prior to the requirement of having a conditional use permit; as a result
it is considered non -conforming with respect to the conditional use permit.
Adjacent Zoning and Land Use: To the west, north, and east is zoned RA-1 and is
vacant. To the south is zoned H-1 and has Glacier View Hospital and a medical plaza
under construction.
The Master Plan designates this area as Medical Professional and anticipates the type
of use proposed.

b. Parks and Recreation: Because of the nature of this facility, no
significant impact on parks or recreation is anticipated.
C. Police: The facility can be adequately served by existing staff and
equipment.
d. Fire Protection: The facility can be adequately served by existing staff
and equipment.
e. Water: The City has adequate supply to service this project.
Resolution of the 8" water main under the addition needs to be
accomplished.
f. Sewer: An "8" sewer main lies in Heritage Way immediately adjacent
to the property.
g. Solid Waste: The site is being adequately served by the Kalispell
Municipal collection service.
h. Roads: The property immediately abuts Heritage Way which is capable
of handling the traffic.
Immediate Neighborhood Impact: This property is one more component of
the growing medical community in the area of the hospital. This type of
development is anticipated. it will be compatible with the adjacent
development occurring and will serve to be an asset to the community.
5. Immediate Neighborhood integrity: As mentioned above, this project will
serve as one more component in an ever increasing medical community
surrounding the hospital. With proper design, it will serve to be an asset to
the community.
6. impact on Property Values: The proposed project will continue to stabilize
and enhance property values in the area as Kalispell moves in the direction
of becoming a regional medical center. The type of development proposed
is compatible with surrounding uses and therefore serves to stabilize and
Protect property values.
SUMMARY OF FINDINGS
The proposed development is an anticipated by the Master Plan and a welcome
addition to the growing Kalispell medical community. There is adequate space on
the site to meet the needs of the proposed facility and parking.
it is recommended that the City -County Planning Board and Zoning Commission
adopt this staff report as Findings of Fact and recommend approval of the
requested Conditional Use Permit, subject to the following requirements and
conditions.

MINUTES OF MEETING
JANUARY 10, 1995
CALL TO ORDER The regularly scheduled meeting of the Kalispell City -
AND ROLL CALL County Planning Board and Zoning Commission was called
to order by Senior Planner John Parsons at 7:00 p.m.
Board members present were Milt Carlson, Robert Lapp,
Walter Bahr, Mike DeGrosky, Therese Hash, Robert
Sanders, Fred Hodgeboom and Pam Kennedy. John Parsons
represented the Flathead Regional Development Office.
rU Brian Wood, Zoning Administrator, represented the City
of Kalispell. There were approximately 45 members of
the public in attendance.
ELECTION OF The next item of business was the election of officers
OFFICERS for 1995. Nominations were opened. The motion was
made and seconded to nominated Therese Hash as
president. There were no other nominations. By
acclamation vote, all members voted aye. Newly elected
President Hash presided over the meeting.
The motion was made and seconded to nominate Pam
Kennedy as Vice President. The nominations were
closed. By acclamation vote all members voted aye.
ELECTION OF Next, was the election to fill the member -at -large
MEMBER AT position on the Board. Letters of interest were
LARGE received from Michael Fraser, Dave Mason and Molly
Schwarz.
Motion The motion to nominate Michael Fraser to fill the ninth
position on the Planning Board was made by Kennedy,
second by Lopp. The Board expressed their appreciation
to the other applicants for their interest and would
like them to apply for future positions on the Planning
Board. On a roll call vote the members voted
unanimously in favor of reappointing Mike Fraser as
member at large on the Planning Board. The appointment
of Mr. Fraser to this position must be confirmed by
both the Board of County Commissioners and Kalispell
City Council prior to him sitting on the Board.
APPROVAL OF The minutes of the meeting of December 13, 1994 were

Amended Motion Kennedy amended the motion to add condition #4 to read:
"That the southwestern access from the parking lot to
the access road and Heritage Way be closed, with an
emergency access gate, to the satisfaction of the
Kalispell Fire Chief, or pave the access road." Bahr
seconded the amendment to the motion.
A roll call vote was taken on the amendment to the
motion. The motion carried unanimously in favor.
On a roll call vote Bahr, DeGrosky, Kennedy, Sanders,
Hodgeboom, Lopp, Carlson and Hash voted unanimously in
favor of granting the conditional use permit for the
expansion of Heritage Place.
EATON ZONE Hash introduced a request by Terry and Pamela Eaton to
CHANGE / amend the West Side Zoning District Map by changing the
R-5 TO B-2 zoning on approximately 15,000 square feet from R-5
(Two family residential) to B-2 (General Business).
The property is generally located on the northwest
corner of Welf Lane and Highway 93, and is further
described as Assessor's Tract 11L, in Section 29, T28N,
R21W, P.M.M., Flathead County.
Staff Report Parsons presented an overview of report #FZC-94-24.
Based on evaluation of the necessary statutory criteria
for a zone change, staff recommended approval.
Public Hearing The public hearing was opened to those in favor of the
zone change.
In Favor
Bill Frey, who owns property immediately west of this
site, which :as storage units on it, spoke in favor of
the Eatons' zone change request. All of the property
in the vicinity is business, and the trend is to
continue that way. The Eatons have made tremendous
improvements to the place, they work hard and deserve
the zone change to allow them to get on with their
lives.
Terry Eaton, the property owner, is in agreement with
the staff report and requested the Board grant the zone
change. He was available to answer any questions.
No one else spoke either in favor or in opposition to
the zone change request. The public hearing was closed
and the meeting opened to Board discussion.
Motion Kennedy made the motion to adopt staff report #FZC-94-
24 and forward a favorable recommendation to the Board
of County Commissioners to change the zone from R-5 to
B-2 (General Business). Lopp seconded. On a roll call
vote the members voted unanimously in favor of the zone
change. The motion carried 8-0.
