James Windorski, applicant, applied to the City of Kalispell
for a conditional use permit to allow the expansion of an existing
casino facility on the property described above.
The Kalispell City -County Planning Board and Zoning
Commission, after due and proper notice, on July 12, 1994 held a
public hearing on the application, took public comment and
recommended that the application be approved subject to three (3)
conditions.
After reviewing the application, the record, the FRDO report,
and after duly considering the matter, the City Council of the City
of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Flathead Regional Development Office, Conditional Use Report
#KCU-94-12 as the Council's finding of fact, and issues and grants
to the above -described real property a conditional use permit for
the expansion of an existing casino facility subject to the
following conditions:
SECTION I.
1. The applicant shall be in conformance to the Kalispell
Zoning Ordinance.
2. The proposed modifications to the building shall be in
substantial conformance with the approved plan of
development/floor plan.
SECTION II.
The conditional use permit, herein granted, shall terminate 18
months from date of issuance if commencement of the authorized
activity has not begun.

Dear Bruce:
The Kalispell City -County Planning Board and Zoning Commission met in regular
session on July 12, 1994, and held a public hearing on the following:
A request by James Windorski for a conditional use permit to allow the
expansion of the casino aspect of Cattlemens within the existing building
in accordance with Section 27.14.030(5) of the Kalispell Zoning
Ordinancne. The exterior of the building, access, and parking would
remain the same. The site is zoned B-2, General Business. The address
is 1400 Airport Road, Kalispell, and is more specifically described as Lots
1,2,3,22,23, and 24, of Bakers Southside Addition, in Section 18, Township
28 North, Range 21 West, Flathead County, Montana.
John Parsons, of FRDO presented the staff report, and recommended granting the
permit subject to three (3) conditions. During the public hearing no one spoke
either in favor or in opposition to the requested conditional use permit.
After brief Board discussion, the motion to adopt the findings of fact in report
#KCU-94-12 and to recommend that City Council grant the conditional use permit
subject to the three conditions set forth in the report, was unanimously passed on
a 6-0 vote.
This recommendation is being forwarded to the City Council for final action. If you
have any questions regarding this request, please contact the Commission or John
Parsons at FRDO.

CATTLEMEN'S CASINO
JUNE 26, 1994
A report to the Kalispell City -County Planning Board and Zoning Commission
regarding a request for a Conditional Use Permit to allow expansion of an existing
casino facility. This request is scheduled for a public hearing at the July 12, 1994
Planning Board Hearing. A recommendation will then be forwarded to the Kalispell
City Council for final action. The hearing will be held in the City Council Chambers,
City Hall, 213 - 1st Avenue East, Kalispell.

The property is approximately 28,000square feet in area, measuring 144 feet
by 183 feet. it is located on the east side of Airport Road approximately 250
south of the Airport Road - Highway 93 intersection. The address is 1400
Airport Road, Kalispell. The property is more specifically described as lots 1,
2, 3, 22, 23, and 24, of Bakers Southside Addition, in Section 18, T28N, R21W,
Flathead County, Montana.
C. NATURE OF REQUEST
The applicant is requesting a Conditional Use Permit to allow the expansion
of the existing casino by 900 square feet, eliminating that amount of area in
the pool room. No expansion of the building footprint is requested. The
site is in the B-2 zone which allows casinos after obtaining a Conditional Use
Permit.
D. LAND USE AND ZONING
Subject property: The existing facility is a single story building with
restaurant, bar, casino, and pool room. The zoning on the property is
currently B-2, General Business Zone. This zone permits this use with a
Conditional Use Permit.
Adjacent property: The area to the north is vacant, east contains a car
wash and gas station, and south is an oil lube facility. All are zoned B-2. To
the west is zoned P-1 and contains the City's maintenance facility.

The Master Plan designates this area as Commercial and anticipates the type
of use.

1. Site Suitability:
a. Adeauate Useable Space: The proposed addition will be internal
to the existing structure.
b. Adequate Access: The existing access from Airport Road and 1st
Street West is adequate for the proposed use.
C. Environmental Constraints: No known or documented
environmental constraints exist on or adjacent to this site.
2. Appropriate Design:
a. Parking Scheme: The site is a conversion of the interior space
of the building, no additional parking would be required.
b. Traffic Circulation: Access from Airport Road and 1st Street
West exists and is adequate to serve the property.
C. Open Space: No changes have been proposed to what is
existing.
d. Fencing/Screening: No changes have been proposed to what is
existing.
e. Landscaping: No changes have been proposed to what is
existing.
f. Signaae: The applicants have not proposed any new signs.

3. Availability of Public Services/Facilities:
a. Schools: Because of the commercial nature of this facility, no
impact on schools is anticipated.
b. Parks and Recreation: Because of the commercial nature of this
facility, no impact on parks or recreation is anticipated.
C. Police: The facility can be adequately served by existing staff
and equipment.
d. Fire Protection: The facility can be adequately served by
existing staff and equipment.
e. Water: Because of the nature of the proposed addition no
impact is expected.
f. Sewer: Because of the nature of the proposed addition no
impact is expected.
g. Solid Waste: The site can be adequately served by the Kalispell
Municipal collection service.
h. Roads: The existing road system appears to adequately serve
the site.
4. immediate Neighborhood Impact: This area has developed with
commercial uses. The proposal will support this concept. No impact
is expect.
S. Immediate Neighborhood Integrity: This project is located within a
site developed already as a bar, casino, and pool room. The project
involves only the conversion of part of the pool hall to the casino use.
No impact is expected
6. impact on Property Values: The proposed project is an expansion of
an existing use within the confines of the existing building. The
proposed development is considered compatibly with adjacent uses
and developments and should have no impact on established property
values in the area.
H. RECOMMENDATION
It is recommended that the City -County Planning Board and Zoning
Commission adopt this report as Findings of Fact and grant the requested
Conditional Use Permit, subject to the following conditions.

Ordinance.
