RE: FINAL PLAT APPLICATION - ASHLEY PARK PHASE I
Dear Bruce:
The above -referenced application has been reviewed for final plat approval. The 30-lot
residential development is located on the west side of Airport Road immediately south
of Ashley Creek. This is the first of seven phases to be filed based on the 240-lot
preliminary plat of Ashley Meadows which received preliminary plat approval by the
County Commissioners on May 10, 1994. A petition for annexation with a zoning
classification of R-4 has been transmitted to the City Council by the Kalispell City
County Planning Board on July 14, 1994 and is pending Council action. This letter
evaluates compliance of the final plat with the conditions of preliminary plat approval
and applicable city and state regulations.
COMPLIANCE WITH CONDITIONS OF APPROVAL:
The County Commissioners approved this preliminary plat with 14 conditions of approval.
I will discuss each condition below:
1. That the subdivision obtain approval from the State Department of Health
and Environmental Sciences.
THIS HAS BEEN GRANTED PER LETTER DATED JUNE 9, 1994, FROM
THE MONTANA DEPARTMENT OF HEALTH AND ENVIRONMENTAL
SCIENCES.
2. All water lines, sanitary sewer, culverts, and storm sewer lines/swales shall
be built according to plans and specifications approved by the City of
Kalispell Public Works Department. All water, sewer main extensions, and
storm sewer lines/swales on private property shall be placed within suitable
easements and approved by the City of Kalispell Public Works Department.
THE DESIGN HAS BEEN APPROVED BY THE CITY PER LETTER FROM
JOHN WILSON, ASSISTANT TO THE CITY ENGINEER DATED JUNE 15,
1994. A SUBDIVISION IMPROVEMENTS AGREEMENT IS ATTACHED
ADDRESSING THOSE IMPROVEMENTS THAT HAVE NOT BEEN
COMPLETED TO DATE.

3. The construction of all streets, curb, gutter, and sidewalks shall be done in
compliance with City of Kalispell standards and approved by the City's Public
Works Department.
THE DESIGN HAS BEEN APPROVED BY THE CITY PER LETTER FROM
JOHN WILSON, ASSISTANT TO THE CITY ENGINEER DATED JUNE 15,
1994. A SUBDIVISION IMPROVEMENTS AGREEMENT IS ATTACHED
ADDRESSING THOSE IMPROVEMENTS THAT HAVE NOT BEEN
COMPLETED TO DATE.
4. A 20-foot reserved strip for right-of-way shall be maintained along the
westerly boundary in common with the rail right-of-way for the future
Alternate Highway 93 route. If the highway is constructed prior to final plat
of Phases 6 and 7, any remainder not used for right-of-way may be included
into adjoining lots, so as to increase their depth.
THIS PHASE OF DEVELOPMENT DOES NOT ABUT THE 20-FOOT
RESERVE STRIP AND THEREFORE IS NOT APPLICABLE.
5. Prior to final plat of Phase 2, installation of the northerly access route
through South Meadows is to be completed.
THIS CONDITION IS NOT APPLICABLE AT THIS TIME.
6. All utilities shall be installed underground.
ALL UTILITIES WILL BE UNDERGROUND PER APPROVED DESIGN
PLANS AS SUBMITTED TO AND APPROVED BY THE CITY.
7. The owner shall pay a cash -in -lieu of parkland payment equal to 1/9 of the
undeveloped market value of that portion of the site proposed for Final Plat.
THE OWNER HAS SUBMITTED A CHECK IN THE AMOUNT OF $2,837
BASED ON THE PURCHASE PRICE OF $3,830/ACRE. SEE ATTACHED
LETTER DATED JULY, 11, 1994, FROM DENNIS CARVER TO JOHN
PARSONS.

8. Placement of fire hydrants shall be approved by the City of Kalispell Fire
Department. Documentation from the Chief of the Kalispell Fire Department
which indicates that the proposed fire suppression facilities are adequate
shall be submitted with the application for Final Plat approval.
THIS HAS BEEN ACCOMPLISHED PER LETTER DATED JULY 18, 1994,
FROM DENNIS CARVER WHICH REFERENCES AN ATTACHED SITE
PLAN APPROVED BY FIRE CHIEF TED WAGGENER.
9. This preliminary plat approval is valid for a period of two (2) years. The
project is also approved in seven (7) phases. This two-year period is based
on approval of Final Plat of Phase 1 within this two (2) years. Upon approval
of each phase an additional two (2) years to receive Final Plat for the next
phase is granted. A one (1) year extension may be granted for each
individual phase. If any phase expires, the remaining unrecorded phases
also expire.
THIS PHASE HAS BEEN SUBMITTED WITHIN THE NECESSARY TIME
FRAME.
10. The lots meet the City of Kalispell Zoning Regulations.
EACH LOT COMPLIES WITH THE KALISPELL R-4 ZONING
CLASSIFICATION.
11. Lot numbers, street addresses, and net acreage for each lot shall be
included on the face of the Final Plat.
THIS HAS BEEN ACCOMPLISHED ON THE FACE OF THE PLAT.
12. All streets shall be clearly signed in a manner conforming to City standards.
STREET SIGNS ARE NOT IN PLACE. THEY ARE INCLUDED IN THE
SUBDIVISION IMPROVEMENTS AGREEMENT.
13. Prior to Final Plat of each phase, a petition to annex shall be presented to
the City of Kalispell.

A PETITION TO ANNEX HAS BEEN SUBMITTED TO THE CITY. THE
KALISPELL CITY -COUNTY PLANNING BOARD HELD A PUBLIC HEARING
ON THIS ISSUE AT THE JULY 12, 1994, PLANNING BOARD MEETING
AND ON JULY 14, 1994, DID FORWARD A RECOMMENDATION TO THE
CITY COUNCIL RECOMMENDING ANNEXATION WITH AN R-4 ZONING
CLASSIFICATION.
14. Street tree planting shall be coordinated in partnership with the City of
Kalispell Parks Department.
DENNIS CARVER, IN A LETTER DATED JULY 5, 1994, TO JOHN
PARSONS INDICATED HE WOULD COOPERATE WITH THE KALISPELL
PARKS DEPARTMENT. STAFF FEELS THIS IS ADEQUATE AT THIS
TIME. THE CITY IS IN THE POSITION TO DELAY APPROVAL OF
FUTURE PHASES IF COOPERATION WERE EVER TO BECOME A
PROBLEM.
COMPLIANCE WITH THE APPROVED PRELIMINARY PLAT
There are no substantial or significant changes to the preliminary plat other than those
required for Final Plat compliance.
COMPLIANCE WITH SUBDIVISION REGULATIONS
The Final Plat is found to be in substantial compliance with the Kalispell City Subdivision
Regulations and Montana Subdivision and Platting Act.
RECOMMENDATION
It is recommended that the Final Plat of Ashley Park Phase I be approved as submitted.
Please note that annexation and assignment of the appropriate R-4 zoning classification
must occur prior to Final Plat approval. The City has 30 days from date of receipt of this
report to complete final review. If you have any questions, do not hesitate to contact this
