Drawer 1997 Kalispell, MT 59903 RE: Final Plat - Kalispell Market Place - Phase II Dear Bruce: The above -referenced final plat has been submitted to this office for review in accordance with the City of Kalispell Subdivision Regulations. The following evaluation of the submitted documents is provided for the Council's consideration and action. BACKGROUND The preliminary plat of this subdivision was conditionally approved by the City Council on October 5, 1993, with four (4) conditions attached. The preliminary plat proposed the creation of five (5) commercial lots between Main Street and Third Avenue East between the Burlington Northern Rail Road and Montana Street. Lot 2 of the subject property is currently occupied by Tidyman's Inc. with the remaining area vacant. The attached final plat indicates the creation of only three (3) lots. Phase 1 also created 3 lots; Lot 1 was the lot created at the southwest corner of 1st Avenue East and Market Place Street, the other two were created on the Tidyman's site. The applicant at this time wishes to proceed with the creation of the remaining lot on the Tidyman's site. This will have the effect of creating a lot on either side of Tidyman's where there was only a lot on the north side previously. Lot 1 will be to the north and Lot 3 to the south of the building. COMPLIANCE WITH CONDITIONS OF PRELIMINARY PLAT The subdivision was granted preliminary plat approval, subject to four (4) conditions. Compliance with each condition is discussed below. Eliminate "designated access points" from the face of the plat; access for each lot will be determined at the time of development. Designated access points have been removed from the preliminary plat. Initiate a zone change to provide a single designation of B-4 for the entire site. The zone change to B-4 was approved by City Council on January 4, 1993, by Ordinance #1181. 3. Include on the face of the final plat all easements, including pedestrian and vehicular access, utility, construction, parking, railroad and self-help easements. All appropriate easements are now shown on the final plat. 4. Provide to the City of Kalispell a final draft of the Declaration of Reciprocal Easements and the Conditions, Covenants and Restrictions for review and approval rp for to application for final plat approval. The declaration of Reciprocal Easements are not necessary for this phase of development. There will be no shared parking area, shared access points, common areas, pedestrian easements, vehicular easements, etc. with this phase. Should the applicant proceed with the resubdivision of Lot 6-B, said easements, covenants and restrictions will be required. The Agreement dated June 20, 1994 has been submitted. COMPLIANCE WITH PRELIMINARY PLAT The final plat submitted generally conforms to the approved preliminary plat. The applicant is platting three (3) lots in Phase II which is a total of 4 lots. COMPLIANCE WITH CITY OF KALISPELL SUBDIVISION REGULATIONS The information submitted is in substantial compliance with the requirements of the City of Kalispell Subdivision Regulations regarding final plats. RECOMMENDATION It is recommended that the final plat of Kalispell Market Place - Phase II be approved as submitted.
