Resolution 1059 - Resolution of Intent - SID 229RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEEENT DISTRICT 140. BE IT RESOLVED BY TEE CITY COUNCIL OF THE CITY OF KALISPELLMONTAkA Sectioh"l. That it is the intention of the City Council of the City of Kalispell to create a special improvement district, hereby designated as Special Improvement District No. 229, and the boundar+ ies of said proposed special improvement district are hereby declared to be as follows: beginning at a point which is the intersection of the centerline of Railroad Street and the cente'rline of the alley between Main Street and First Avenue East; thence in a westerly dir- ection along the centerline of Railroad Street to its intersection with the centerline of the alley between Main Street and First Avenue West; thence in a southerly direction along the centerline of this alley to its intersection with the centerline of Fourth Street; thence in an easterly direction along the centerline of Fourth Street to its Intersection with the centerline of the alley between Main Street and First Avenue East; thence in a northerly direction along the centerline of this alley to its intersection with the centerline of Railroad Street which is the point of beginning. Section 2. That the general character of the improvements to be made in said proposed Special Improvement District is as follows, to -wit: resurfacing of Main Street from Railroad Street to Fourth Stteet over the existing pavement with two (2) inches of one of the following surface materials: Topeka, Sheet Asphalt, Bituminous Concrete or Warrentie-Bitulithic. Also to include the proper cleaning, repairing, flushcoating, sand course, rolling, etc.., of the existing pavement where necessary. Section 3. That the approximate cost of said improvement is $17,712.00. section 4. That the entire coat and expense of such improvements including street anNq ey intersections, shall be assessed against the entire district, each lot or parcel of land within such district to be assessed for that part of the whole cost which its area bears to the area of the entire district exclusive of streets, alleys and public places. Section 5. That said assessment shall be paid for in ten equal annual installments hereby extended over a period of ten years. Said assessment shall constitute a fund to be known as Special Improvement District Fund No. 229. Section 6. That said improvements shall be paid for in Special Improvement District Coupon Warrants issued against said district in the sum of $100.00 each, bearing interest at 6 per cent. per annum from the date of registration until called for redemption or paid in full, interest payable annually on the first day of January of each year, payable ten years from date and redeemable at any time there are funds to the credit of such Improvement District fund available therefor; the interest coupons attached to such warrants to bear the fac—simile signatures of the Mayor and Clerk. Section 7. That on the day of __-1925, at the Council Chambers in the City Hall of the City of Kalispell, Montana, at 7:30 o'clock p.m., a regular meeting, the City Council will hear and pass upon all protests that may be made against the making of such improvements or the creation of such district. Section 8. The City Clerk is hereby authorized and directed to give the proper notice of the passage of this resolution by publication and mailing as required by law, such publication to be made in the Kalispell Times a weekly newspaper published in the City of Xaiapell.
