This afternoon, I spoke with Merlyn Miller, Architect with Miller Levine
Architects P.C., regarding the City Hall Re -roofing project specifications.
Mr. Miller advised me that all specifications had been mailed to you on Saturday
and should be delivered today. Also, he told me that this afternoon he had FAXED you a
suggested materials list and a recommended bid format and other information. I did not have
a chance to check with you before my 4:00 pm meeting regarding Equity Supply.
At tonight's City Council Work Session I would like to present the following
information Mr. Miller related via telephone this afternoon. He is in Billings and unable to
attend the Work Session.

1. The latest cost estimate is $90,000 for the work specified. Our budget is
$82,000. The $48;880 estimate and work recommended by Miller includes the following
assumptions: O�P, cx)z)
a. $1.15/SF to tear -off the existing roof and dispose of it in the Flathead
County landfill. Miller recommends removing the existing roof because
the present City Hall roof structure is "maxed out" and close to its
maximum load bearing capacity. Thus, removal of the existing roof
material will reduce weight, help with the dead load issue and enable the
city to get rid of any obsolete roofing material which may have been
installed with the original.
b. $.80/SF for 2" rigid insulation. At the current cost of natural gas the
payback period is estimated to be 19 years. Even though this is a longer
than originally expected cost recovery, they still will recommend this 2"
rigid insulation solution.

2. The specifications do not include disconnecting the city hall roof drains from the
sanitary sewer. Miller suggested that this should be handled separately from the main
re -roofing project so that it could be done by local plumbing contractors at an estimated
cost of less than $5,000. Miller said that he would communicate with John Wilson to
help define the problem and the best solution so that a description of the work could be
developed. I asked that he call John Wilson this p.m.
Please request that the Council allow us to prepare the final notice to advertise
for bids for this project so that the work may be committed this budget year.

I have enclosed for your review and comment the following items which pertain to

The balance of the construction documents were previously sent to your office by

The construction documents are based upon the following facts:
1. City Rail roof structural design does not 'calc'' out under current snow
loading codes to accommodeite additional dead load. Our position is that
by removing the existing built-up roofing, replacement roofing and
Insulation can be added without imposing additional dead load on the
structure.
2. We have shown 2 inches of insulation to be added to the roof system. Our
basis for this is more practical than economic at this time sine the pay
back is not all that attractive. The existing roof insulation provides
approximately R-1 1, two inches of Insulation would bring this to R-24.
Energy saved would be 170 MCF per year. At the current price of
$4.05/MCF, your payback will be 19 years.
We believe that even at this extended payback, the added insulation Is a
good investrr*nt. It will be man years a ors this new roof wili need to be
replaced, and without a roofing job to tag onto, insulation is very difficult to
install.
We are prepared to issue this project for bidding as soon as you give us your
approval or recommendation for modifications.

8 Until the work is 50% complete, the owner will pay 90% of the
9 amount due the Contractor on account of progress payments. At the
10 time the Mork is 50% complete and thereafter, if the manner of

Without limiting any of the other obligations or liabilities of the

Contractor, Contractor shall secure and maintain such insurance

from an insurance company (or companies) authorized to write

and the Architect/Engineer and their respective agents and

employees from claims for bodily injury, death or property damage

which may arise from operations and completed operations under this

Agreement. Such coverage shall be written for claims arising out

9.1.1 The Bidder's attention is also directed to Section
15 ch. 50.101 MCA. Under the provisions of this law,
each "Public Contractor" shall pay the State, in
addition to the Contractor's License fees, a sum
equal to one percent (it) of all monies due to the
Contractor and shall transmit such Monies to the
Montana Department of Revenue along with a Cross
Receipts Withholding Report (Form PC-02).

agrees that the Owner may retain ONE HUNDRED DOLLARS
($100.00) for each calendar day thereafter, Sundays
and Holidays included, that the work of the entire
project remains uncompleted. This spun is agreed upon
as the proper measure of liquidated damages which the
Owner will sustain per diem by the failure of the
undersigned to complete the work in the time
stipulated.
9.4.2 Where, under the contract, additional time is
allowed for completion of any work, the new time
limit faxed by such extension shall be the essence of
this contract. The Contractor shall not be charged
with liquidated damages or any excess cost when the
delay of completion of the work is due to:

9.4.2.1 Any preference, pr16ri.ty or allocation order
issued by the Federal Government.
9.4.2.2 Unforeseeable cause beyond the control and
without the fault or neglect of the Contractor,
including acts of God, public entity, acts of
another Contractor in performance of a contract,
with the Owner, fires, floods, epidemics,
stra.kes, freight embargoes, or unusually severe
weather.
9.4.2.3 Failure or delay in delivery of Owner
furnished equipment.
9.4.3 The Contractor shall within i days from the
heginninq of such delay, notify the owner in writing
stating cause of delay. The Owner shall ascertain
facts and extent of delay and notify the Contractor
within a reasonable time of its decision in allowing
an extension of time.
