This afternoon, I spoke with Merlyn Miller, Architect with Miller Levine
Architects P.C., regarding the City Hall Re -roofing project specifications.
Mr. Miller advised me that all specifications had been mailed to you on Saturday
and should be delivered today. Also, he told me that this afternoon he had FAXED you a
suggested materials list and a recommended bid format and other information. I did not have
a chance to check with you before my 4:00 pm meeting regarding Equity Supply.
At tonight's City Council Work Session I would like to present the following
information Mr. Miller related via telephone this afternoon. He is in Billings and unable to
attend the Work Session.

1. The latest cost estimate is $90,000 for the work specified. Our budget is
$82,000. The-$90 000 stimate and work recommended by Miller includes the following
assumptions:
a. $1.15/SF to tear -off the existing roof and dispose of it in the Flathead
County landfill. Miller recommends removing the existing roof because
the present City Hall roof structure is "maxed out" and close to its
maximum load bearing capacity. Thus, removal of the existing roof
material will reduce weight, help with the dead load issue and enable the
city to get rid of any obsolete roofing material which may have been
installed with the original.
b. $.80/SF for 2" rigid insulation. At the current cost of natural gas the
payback period is estimated to be 19 years. Even though this is a longer
than originally expected cost recovery, they still will recommend this 2"
rigid insulation solution.

2. The specifications do not include disconnecting the city hall roof drains from the
sanitary sewer. Miller suggested that this should be handled separately from the main
re -roofing project so that it could be done by local plumbing contractors at an estimated
cost of less than $5,000. Miller said that he would communicate with John Wilson to
help define the problem and the best solution so that a description of the work could be
developed. I asked that he call John Wilson this p.m.
Please request that the Council allow us to prepare the final notice to advertise
for bids for this project so that the work may be committed this budget year.

I have enclosed for your review and comment the following items which pertain to
the lidding process for this project.
1. Invitation for bids

The balance of the construction documents were previously sent to your office by
mail.
The construction documents are based upon the following facts:
1. CIty Halt roof structural design dues not "talc" out under Current snow
loading codes to accommodate additional dead load. Our position is that
by riving the existing built-up roofing, replacement roofing and
insulation can be added without imposing additional dead load on the
structure.
2. We have shown 2 inches of insulation to be added to the roof system. Our
bads for this is more practical than economic at this time since the pay
back is not all that attractive. The existing roof insulation provides
approximately R-11, two inches of insulation would bring this to R-24.
Energy saved would be 170 MCF per year. At the current prig of
$4.05//MCF, your payback wilt be 19 years.
We believe that even at this extended payback, the added insulation Is a
good investment. It will be many years bbafore this new roof will need to be
replaced, and without a roofing job to tag ortto, insulation is very difficult to
install.
We are prepared to issue this project for bidding as soon as you give us your
approval or recommendation for modifications.

submitted on the form provided with the contract documents. One complete sat
of Drawings and Specifications may be procured from Miller Levine Archliects,
P.C., 331 Third Avenue North, Billings, Montana 59101 upon deposit of Fifty
Dollars ($50.00) as a guarantee of the safe return of the bid documents in good
condition with thirty dollars ($30.00) refundable. No refund will be made on
documents returned later than ten (10) days after the bids are opened or on
documents received in poor condition.
Bias shall be accomparded by the bid security, meeting the requirements sat forth,
in the amount of ten percent (10%) of the total bid. Successful bidder will furnish
an approved Performance Bond and Labor Material Bond each in the amount of
101 of the contract.
They Contractor shall comply with all fair labor practices and shall meet the
41,/ requirements as to conditions of employment to be observed and a minimum
wage rates to be paid under the contract.

Each prime bidder and subcontractor will be required to have a current Montana
Public Contractor's License of the proper class. No bidder may withdraw his bid
within thirty 30) days after the actual date of the bid opening. The Owner
reserves the right to waive any informalities or reject any or all bids.

8 Until the Work is SDI, complete, the owner will pay 90% of the
9 amount due the Contractor on account of progress payments. At the
10 time the Work is 50% complete and thereafter, if the manner of
11 completion of the Work and its progress are and remain satisfactory
12 to the Architect, and in the absence of other good and sufficient
13 reasons, the Architect will authorize any remaining partial payment
14 to be paid in full.

38 Without limiting any of the other obligations or liabilities of the
39 Contractor, Contractor shall secure and maintain such insurance

41 insurance in the State of Montana, with minimum "A. M. Best Rating"
42 of B+, V21 as will protect himself his subcontractors, the owner
43 and the Architect/Engineer and their respective agents and
44 employees from claims for bodily injury, death or property damage
45 which may arise from operations and completed operations under this
46 Agreement. Such coverage shall be written for claims arising out
47 of all premises/operati.ons, subcontracted operations, products/
48 completed operations, and all liability assumed by the Contractor
49 under any contract or agreement. Contractor shall not commence
50 work under this Agreement until such insurance has been obtained

9.4.2.1 Any preference, priority or allocation order
issued by the Federal Government.
9.4.2.2 Unforeseeable cause beyond the control and
without the fault or neglect of the Contractor,
including acts of God, public entity, acts of
another Contractor in perfomance of a contract
with the Owner, fires, floods, epidemics,
strikes, freight embargoes, or unusually severe
weather.
9.4.2.3 Failure or delay in delivery of Owner
furnished equipment.
9.4.3 The Contractor shall within 7 days from the
beginning of such defy, notify the owner in writing
stating cause of delay. The Owner shall ascertain
facts and extent of delay and notify the Contractor
within a reasonable time of its decision in allowing
an extension of time.
