03. Ordinance 1208 - 1st Reading - Text Amendment - Medical ParkingORDINANCE NO. 1208 AN ORDINANCE AMENDING SECTION 27.26.050(29), CITY OF KALISPELL ZONING ORDINANCE NO. 1175. NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That Section 27.26.050(29), City of Kalispell Zoning Ordinance No. 1175 is hereby amended to read as follows: "Medical and Dental Offices: 1 per 150 gross square feet of floor area, unless located within the H-1 zone, where 1 space per each 200 gross square feet of floor area is required." SECTION II. This Ordinance shall become effective thirty ( 30 ) days from and after the date of its final passage by the City Council and approval by the Mayor. Medical and Dental Offices: 1 per 150 gross square feet of floor area, unless located within the H-1 zone, where 1 space per each 200 gross square feet of floor area is required." John Parsons, of FRDO presented the staff report, which recommended the text amendment. There was no testimony either for or against the request. After adopting the findings of fact, the Board voted 9-0 in favor of recommending the requested text amendment to amend the parking requirements for medical facilities in the H-1 zone classification. The Planning Staff has been requested by the Kalispell City -County Planning Board and Zoning Commission to address a specific area of the adopted zoning ordinance. The parking requirements for medical and dental offices, Section 27.26.050(29), require 1 parking space for every 150 square feet of gross floor area regardless of zone. The change would require 1 space per each 150 gross square feet of floor area, unless located in the H-1 zone, where 1 space per each 200 square feet of floor area would be required. CHAPTER 27.26 - OFF STREET PARKING: The intent of this section follows: The intent of this section is to reduce traffic congestion and the need for parking on public streets and hazards caused thereby, and to provide off- street parking adequate for each type of development in terms of quantity, location, and design. ANALYSIS: The question involves whether or not medical and dental uses on a property should require 1 parking space for every 150 square feet of gross floor area or should that ratio be reduced? In my experience with other jurisdictions and conversations with other planning agencies it is felt that a ratio of 1 space for every 200 square feet of floor area is adequate for medical uses. The following is a list of Montana jurisdictions and the ratio used by that jurisdiction which support the change: JURISDICTION SPACES PER SQUARE FOOTAGE HELENA 4.11 1000 BILLINGS 1 200 for the first 1000 square feet, then 1 per 250 GREAT FALLS 1 200 M I SSOU LA 1 200 BUTTE 1 250 it is felt by staff that a ratio of 1/150for medical uses not in the H-1 zone is still appropriate because of the multiplicity of the H-1 zone. An individual would be able to fulfill multiple medical needs without driving and reparking, thereby reducing the amount of parking required. This is much the same way a shopping center works for retail sales. it is recommended that the text of Chapter 27.26 Off Street Parking of the Kalispell Zoning Ordinance be amended as follows: Chapter 27.26 Off Street -Parking Section 27.26.050(29). Wood, Zoning Administrator March .2, 1994 Zoning Ordinance Amendment - Parking In The H-1 Zone re aware, the Kalispell City Council granted the Senses Partnership a Conditional Use Permit for a linic in November of 1993. During the public hearing matter before the Kalispell City -County Planning t was suggested by the applicant that the city amending its off-street parking requirements for and dental clinics located within the H-1 zone The planning board, in its recommendation to the council, was supportive of both the CUP for. the clinic and the amended parking requirement. City staff, through the Site Development Review Committee, is also supportive of the change. The matter was also discussed at council level, with no apparent opposition perceived. Therefore, I am requesting that the FRDO schedule a public hearing before the planning board at their April 12, 1994 meeting. The amendment should be easily integrated into, the ordinance. I would suggest that section 27.26.050(29) be amended to read: (29).
