The 0.87 acres of developed property is located at 2141 3rd Ave East, on the east side of 3rd Ave East, southeast of Lions Park. The property can be described as Tract 8C in the northeast 1/ of the northwest 1/ of Section 20, Township 28 North, Range 21 West P.M.M., Flathead County, Montana. The owners have requested annexation and city zoning in order to connect the property to city sewer service. The property is adjacent to incorporated City of Kalispell lands on two sides. Staff recommended approval of the annexation with initial zoning of B-2 (General Business). The request was forwarded to the Council with a positive recommendation on a unanimous vote of 6-0. RECOMMENDATION: A motion to approve the annexation with an initial zoning classification of B-2 (General Business). FISCAL EFFECTS: Approval of the request would have slightly positive fiscal impacts to the City. ALTERNATIVES: Deny the request. That all the real property located at 2141 Third Avenue East, Kalispell, Montana and more particularly described in Exhibit "A" attached hereto and fully incorporated herein by this reference be annexed to the City of Kalispell and the boundary of the City is altered to so provide, and shall be known as More Schreiner Addition No. 422. SECTION 2. Upon the effective date of this Resolution, the City Clerk is directed to make and certify under the seal of the City, a copy of the record of these proceedings as are entered on the minutes of the City Council and file said documents with the Flathead County Clerk and Recorder. From and after the date of filing of said documents as prepared by the City Clerk, or on the effective date hereof, whichever shall occur later, said annexed territory is part of the City of Kalispell and its citizens and property shall be subject to all debts, laws and ordinances and regulations in force in the City of Kalispell and shall be entitled to the same privileges and benefits as are other parts of the City. Tom Jentz and Kevin LeClair represented the Kalispell Planning Department. Board President Graham took a moment to thank members Pesola and Regier for re -upping the terms on the Board. He also welcomed a new Board member, Karlene Osorio-Khor. ELECTION OF OFFICERS President Graham explained that it had been a year since the Planning Board had elected officers. Kalispell City Planning Board Minutes of the meeting of May 13, 2014 Pagel of 4 STAFF REPORT KA-14-03 Kevin LeClair, representing the Kalispell Planning Office reviewed staff report KCU-14-03 for the board. LeClair reviewed the location of the property adjacent to the existing City of Kalispell boundary and the commercial area along Highway 93 South, near the Hilton Garden Inn, Rosauers and the City Airport. LeClair displayed an aerial photo showing the developed nature of the property and the existence of a waterway on the eastern third of the property. He explained that the property is currently being used as an office for a commercial roofing contractor. LeClair reviewed the requested B-2 (general business) zoning of the property and explained how it complied with the "commercial" designation in the Kalispell Growth Policy. LeClair then reviewed the cost of service analyses that were prepared for the Board's consideration. The first was an estimate of the cost to serve the property currently, or if it were not annexed into the city. The cost was $530 per year. The second analysis was an estimate of the costs and revenues generated by the property if it were to annex into the city. The property is estimated to generate $2,278 in revenue from taxes, assessments and usage fees, if annexed. Staff recommended that the Kalispell City Planning Board adopt staff report KA-14-03 as findings of fact and recommend that the Kalispell City Council approve the annexation of the property into the City of Kalispell and adopt an initial zoning designation of B-2 (General Business). BOARD DISCUSSION Larch asked where the boundary was between the county zoning designations of B-2 and R-2. LeClair explained that the boundary was along the western edge of the Green Acres residential subdivision located east of the subject property. Graham asked about the revenue shown in the preannexation side of the cost of service analysis. LeClair explained that the property was already connected to city water service and the $178 shown was the revenue from their annual water bill for the property. Graham then asked about the condition of the property's private septic system. LeClair reported that the property owner had said the pipe connecting the structure to the septic system has been partially crushed. The property owner would like to decommission the septic system and connect to city sewer which is available in 3rd Avenue East adjacent to the property. MOTION Lorch moved and Young seconded a motion to adopt staff report KCU-14-03 as findings of fact and recommend that the Kalispell City Council approve the annexation of the property into the City of Kalispell and adopt an initial zoning designation of B-2 (General Business). BOARD DISCUSSION Osorio-Khor asked if the property owner normally attends the hearing. LeClair said that it is customary for the owner to attend but it is not required. Staff had informed the owner that the issue was not contentious and their attendance would probably not be needed. Osorio-Khor asked how many unincorporated properties are receiving city water service. Jentz explained that the Planning Department has mapped that information in the past and could provide that information to the Board at a subsequent meeting. ROLL CALL The motion passed unanimously on a roll call vote. OLD BUSINESS: LeClair noted that each Board member had been given a copy of the Draft Kalispell Growth Policy PLAN -IT 2030 for their review and discussion at their upcoming meeting in June. LeClair mentioned that Planning Department staff had been attending meetings with key stakeholder groups, such as the Chamber of Commerce to let them know that the document was available for review on the city's website. Young asked if there was any unfair advantage being given to any one group. LeClair explained that there was no unfair advantage because they were informational in nature and that any feedback received would be relayed to the Board. In addition, any member of the public has the same opportunity to provide feedback to the Board either directly at a meeting or via the Planning Department at any time. LeClair then explained that a neighborhood meeting was being held at the Flathead High School Auditorium on Wednesday, May 14, at b PM to discuss the residential parking district solution that the resident volunteers have come up with. The Board members were invited to attend if they wished. Graham asked about the process that would be followed once the community group had a solution they would like considered by the City. LeClair explained that when they were ready the neighborhood volunteers would be making a formal proposal to Planning Board for consideration and a public hearing. The Board would then make a recommendation to the City Council for final Kalispell City Planning Board Minutes of the meeting of May 13, 2014 Page 3 of 4 consideration. Graham asked why on -street parking was something the Board would work on. LeClair noted that the impact of commuter parking on the Westside neighborhood is believed to be affecting the quality of life for residents in the neighborhood and the Board's role is consider city policies regarding the use of land and how they support the quality of life for Kalispell's residents. For that reason, it seemed most appropriate that the Planning Board be the first official public body to review and consider any possible changes to how on -street parking in a residential neighborhood is managed. NEW BUSINESS: LeClair remarked that the Planning Department had received applications for two conditional use permits. One for a residential care facility on Stillwater Road. The other for a group home for 8 or fewer residents on P Avenue East. The Planning Department expects these two items to be on the Planning Board's agenda in June. A public hearing has been scheduled before the Kalispell City Planning Board for May 13, 2014 beginning at 7:00 PM, to consider the annexation request and the appropriate zoning for the property to be annexed. The planning board will forward a recommendation to the Kalispell City Council for consideration. BACKGROUND INFORMATION The owner, More Schreiner Investments LLC, has petitioned for annexation and an initial zoning designation of B-2 (General Business) on a 0.87 acre tract adjacent to the City of Kalispell boundary. The owner is requesting annexation in order to access city sewer service, which is available in the public right-of-way adjacent to the property. This report evaluates the annexation request and the appropriate assignment of a city zoning classification in accordance with Section 27.03.010(4) of the Kalispell Zoning Ordinance. This property will be annexed under the provisions of Sections 7-2-4601 through 7-2-4610, M.C.A., Annexation by Petition. A. Petitioner / Owner: More Schreiner Investments, LLC Attn: Cody Schreiner P.O. Box 3314 Kalispell, MT 59903 B. Location and Legal Description of Properties: The tract under consideration is located at 2141 3rd Ave East. The tract can be described as Tract 8C in the northeast 1/4 of the northwest 1/4 of Section 20, Township 28 North, Range 21 West P.M.M., Flathead. County, Montana. C. Existing Land Use and Zoning: The property is developed with a commercial structure on its western third that is being used as offices for a commercial roofing business. The current County zoning on the property is B-2 (General Business). The Flathead County Zoning Regulations define this district as, "A business district to provide for those retail sales and service functions and operations that are typically characterized by outdoor display, storage, and/or sale of merchandise, by major repair of motor vehicles, and by outdoor commercial amusement and recreational activities. This district should also serve the general needs of the tourist and traveler." Figure 1: Aerial view of site D. Proposed Zoning: The City of Kalispell zoning proposed for the site is B-2 (General Business). The Kalispell Zoning Regulations state that the B-2 zoning district is, "A district which provides for a variety of sales and service establishments to serve both the residents of the area and the traveling public. This district depends on the proximity to major streets and arterials and should be located in business corridors or in islands. This zoning district would typically be found in areas designated as commercial and urban mixed use on the Kalispell Growth Policy Fixture Land Use Map." E. Size: The tract is 0.87 acres in size. The property is approximately 61 feet wide and 635 feet deep. F. Adjacent Land Uses and Zoning: The property is bordered by private property on three sides and a public right-of-way on one side. General Land Use Character. The general land use character of this area can be described as commercial. The active land uses in the area include a commercial roofing company's offices, an engineering firm's professional offices, and a taxidermy studio. There are two residential properties north of the site, but they are out of character with the predominant land use in the area, which is commercial. There is a single-family residential neighborhood. (Greenacres West Subdivision) adjacent to the site's eastern boundary, but there is a surface water body on the eastern third of the property that separates the developable portion from the neighborhood. H. Utilities and Public Services: City water and sewer mains are both located in the public right-of-way of 3*d Ave E. If annexed, the property owner intends to connect to the City sewer line. The property is already accessing city water service. The owner would be required to pay the cost for the utility connection. The design and sizing of these utilities will be reviewed and approved by the Kalispell Public Works Department. The annexation policy boundary represents the area where direct annexation upon a request by the property owner would be supported by the city. Municipal Services: Municipal services, such as sewer mains and water mains, are located within the public right-of-way of 3rd Ave E. The property owner is already connected to city water and is seeking to connect to city sewer following annexation. The site is currently protected by the South Kalispell Fire District and the Flathead County Sheriff's office. The applicant has submitted a Notice of Withdrawal from Rural Fire District. At the time of annexation, the property will be served by the Kalispell Fire Department. Similarly, the property will be served by the Kalispell Police Department upon annexation. The Kalispell Fire and Police Station are located approximately 1.4 miles from the property. Distance from current city limits: The site is adjacent to the city limits along its western and southern boundaries. Cost of services: Once annexed to the city, full city services (sewer connection) will be made available to the property owner. Any necessary infrastructure associated with this connection will be at the cost of the property owner and will be constructed in accordance with the City of Kalispell's Design and Construction Standards. The attached cost of services analysis prepared for this property is for a commercial annexation on an already -developed property. The analysis is an estimate based on a variety of assumptions. The analysis does not take into consideration changes in methods of assessment and estimated costs associated with services. The information should be used as a general estimate of the anticipated cost of services and revenue. The cost to serve the land proposed for annexation is shown in the attached cost of service analysis - Developed Property Annexation. The total cost of services is estimated to be $1,186. Based on the city's taxation and assessment policies, the property will generate approximately $3,465 in total annual 4 revenue to the city ($1,866 in taxes and $1,599 in assessments and use charges). Based on this analysis, the annexation will generate annual revenues of approximately $2,278 to the city. One other cost of services analysis was prepared for this annexation - Developed Property Without Annexation - that estimates the costs and revenues for the property if it were not annexed into the city. Because of the property's adjacency to the city right-of-way and the fact that is in a wholly surrounded area, there are certain basic city services that the property is already benefitting from. These include police and fire response that would occur if a disturbance or fire were reported to the 911 center. Another benefit is the property access onto 3rd Ave E, a city street. For these services, the city does not receive any tax revenue, or any special assessments. The city does collect water usage charges from the property, because it is connected to the city's water system. The cost to the city to serve the property, if it is not annexed, is approximately $529 per year. II. IMTIAL ZOMNG EVALUATION BASED ON STATUTORY CRITERIA The statutory basis for reviewing a change in zoning is set forth by 76-2-303, M.C.A. Findings of fact for the zone change request are discussed relative to the itemized criteria described by 76-2-304, M.C.A. and Section 27.29.020, Kalispell Zoning Ordinance. 1. Does the requested zone comply with the growth policy? The Kalispell Growth Policy designation for the site is "Commercial." The Growth Policy states that, "established commercial districts along major arterials are anticipated to provide areas for commercial uses that require space for outdoor display of merchandise, storage of materials and/or equipment and outdoor sales areas as well as general retail." The requested B-2 (General Business) zone is in compliance with the Growth Policy's commercial designation for this property. 5 2. _Will the requested zone have an effect on motorized and nonmoterized transportation systems? The requested zone is not expected to have an effect on the motorized transportation system. The property is currently developed with a single commercial structure that has direct access onto 3-d Ave E. There are no non - motorized facilities in the immediate vicinity. if the property is annexed and zoned B-2, it may redevelop in the future. At that time, improvements to the public right-of-way will be required by Kalispell's Zoning Ordinance. 3. Will the requested zone secure safety from fire, panic, and other dangers? Adequate access and public facilities are available to the site in the case of an emergency. There are no features related to the property which would compromise the safety of the public. All municipal services including police and fire protection, water, and sewer service are or will be made available to the property. 4. Will the requested zone promote the public health, safety and general welfare? The requested zoning classification will promote the health and general welfare by restricting land uses to those that would be compatible with the adjoining properties. The adjacent land uses are all of a general commercial nature, with the exception of the residential neighborhood to the east. As stated before, the residential neighborhood is physically separated from the developable portion of the property by a surface water body. There are several single-family residences located north of the property, but separated by a vacant lot. These properties are zoned County B-2 (General Business) and have greater development potential than single-family residential. 31 5. Will the requested zone provide for adequate light and air? Setback, height, and lot coverage standards for development on this site are contained in the Kalispell Zoning Ordinance to ensure adequate light and air is provided. 6. Will the requested zone promote compatible urban growth? The requested B-2 zoning district allows the property to be used for its existing use as an office for a commercial roofing business. The requested B-2 zone also allows for commercial redevelopment on the site that is compatible with the commercial nature of the area in which it is located. 7. Will the requested zone facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other 2ublic requirements? Public services and facilities are available to serve the property. The property is already served by a city street and city water service. There is city sewer available in the public right-of-way of 3rd Ave E. The property owner is seeking to connect to the city sewer and disconnect their existing private sewer system. The requested general business zone is not expected to impact park or school facilities. 8. Does the requested zone give consideration to the particular suitability of the property for particular uses? The proposed B-2 zoning district is consistent with the surrounding commercial character of the area and its close proximity of Highway 93 South. The requested B-2 zoning district gives due consideration of the suitability of this property for the permitted uses in the zoning district. 9. Does the requested zone give reasonable consideration to the character of the district? The general character of the area is commercial, with a couple of residential properties to the north of the area to be annexed. By assigning the property with the B-2 zoning district, the continued use and future development of this property will be consistent with the commercial character of the area. The proposed zoning is also consistent with the City B-2 zoning to the south and the County B-2 zoning to the north. 10. Will the requested zone avoid undue concentration of people? The property is currently developed with a commercial structure that is being used as an office for a commercial roofing business. This use is expected to continue for the foreseeable future. In its current state there is no undue concentration of people, as there are adequate public facilities and services available to serve the property. If the property were to redevelop, there are adequate public facilities and services available to serve the potential future uses of the property. 7 11. Will the proposed zone conserve the value of buildings? The building currently located on the property is an assemblage of several different building types that have been added on to each other. The value of the structure will not be affected by the requested zoning designation. There are several commercial structures located south of the property that are in good condition. Their values will be conserved by the application of the B-2 zoning district on this property. 12. Will the requested zone encourage the most appropriate use of the land throughout the municipality? Commercial development should be encouraged in areas where services and facilities are available. In this case water and sewer lines are located within the public right-of-way adjacent to the west boundary of the property. The proposed zoning is consistent with the city growth policy future land use designation. RECOMMENDATION It is recommended that the Kalispell City Planning Board and Zoning Commission adopt Staff Report #KA-14-03 as findings of fact and recommend to the Kalispell City Council that the property be annexed and the initial zoning for this property upon annexation be B-2, General Business.
