Al The Kalispell City Planning Board and Zoning Commission, after due and proper notice, o April 8, 2014, held a public hearing on the application, took public comment and recommended th the application be approved subject to eight conditions. I After reviewing the application, the record, the Kalispell Planning Department report,, and after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby adopts Kalispell Planning Department Conditional Use Report #KCU- 14- 01 as the Council's findings of fact, and issues and grants to the above -described real property a conditional use permit to allow the construction of a homeless shelter to accommodate up to 15 women and children in the RA-2, Residential Apartment/Office zoning district, subject to the following conditions: General Conditions Due to the traffic volumes on 5th Avenue West, a minor arterial, no vehicle access on the property from 5th Avenue West will be allowed. The property should be accessed either from the alley on the west side of the property, or from I st Street West, at a location approved by Kalispell Public Works. If a sign is installed on the property to identify it as a Ray of Hope facility, the property owner shall apply for and receive a sign permit that is in compliance with Chapter 27.22 of the Kalispell Zoning Ordinance. (Findings of Fact, Section B.2) Prior to issuance of the Building Permit 4L:7 3. To ensure the proposed structure is compatible with the architecture and character of the surrounding neighborhood, the building permit shall receive Architectural Review Committee (ARC) approval prior to issuance of the building permit. (Findings of Fact, Section B. 1) 4. To ensure the traffic flow and access comply with the Kalispell Design and Construction Standards, the building permit shall receive Site Review Committee approval prior to issuance of the building permit. (Findings of Fact, Section B. 1) 5. To ensure the property is fully landscaped and is compatible with the surrounding neighborhood, a landscape plan shall be submitted along with the building permit. The landscape plan shall be approved by the Parks Department prior to issuance of the building permit. (Findings of Fact, Section B.2) F,�rior to issuance of the Certificate of Occupancy 6. If the applicant chooses to provide all vehicular access to the property via the public alley on the rear of the property, the existing curb cut on 1st Street West, that serves the existing garage, should be removed and new curbing installed that is consistent with the curbing to the east of the curb cut. To ensure the continual improvement of pedestrian access for the community, a sidewalk shall be installed in the public right of way along 1st Street West and the curb ramp at the southwest comer of 5th Avenue West and 1 st Street West upgraded to ADA standards. The design and location of the sidewalk and curb ramp shall be reviewed and approved by the Public Works Department. After installation, the sidewalk and curb ramp shall be inspected and approved by the Public Works Department. (Kalispell Standards for Design and Construction and Findings of Fact, Section B. 1) 8. To provide privacy and security to the neighboring property to the south, a privacy fence of at least six (6) feet tall shall be constructed along the entire southern property boundary, except. for the portion of the southern property boundary where the fence shall be no taller than four (4) feet tall.
