Final Plat - Bright View SubdivisionPlanning Department 201 lst Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.kafispell.com/planning April 30, 2014 Doug Russell, City Manager City of Kalispell 201 1st Ave E Kalispell, MT 59901 Re: Final plat request for Bright View Subdivision, Phase 1 Dear Doug: CTA Architects -Engineers Inc. submitted a request, on behalf of the Montana Department of Natural Resources, for final plat approval of the Bright View Subdivision Phase 1, a 3-lot commercial subdivision in the North %2 of Section 36, Township 29 North, Range 22 West., P.M.,M., Flathead County, Montana. The subdivision is the first phase of a commercial development that the City Council preliminarily approved with 15 conditions in September 2013 with Resolution 95649. All of the conditions have been met or adequately addressed. The following report summarizes the applicant's compliance with the conditions of approval contained within Resolution #5649. COMPLIANCE WITH CONDITIONS OF APPROVAL General Conditions: 1. The development of the site shall be in substantial compliance with the application submitted, the site plan, materials and other specifications as well as any additional conditions associated with the preliminary plat as approved by the city council. (Kalispell Subdivision Regulations, Appendix C — Final Plat) Staff Response: This condition has been met. The development on the site is substantially complete and in compliance with the approved preliminary plat. The lot layout and utility installations match those that were proposed under the preliminary plat. 2. The preliminary plat approval shall be valid for a period of three years from the date of approval. (Kalispell Subdivision Regulations, Section 2.04). Staff Response: This condition has been met. The application for final plat was submitted prior to the expiration of the preliminary plat approval. 3. Concurrent with development on or subdivision of the proposed Lot 3 Timberwolf Parkway as required by Kalispell Subdivision Regulations shall be extended to intersect through to West Reserve Drive and the corresponding right-of-way granted to the City of Kalispell. (Kalispell Subdivision Regulations, Section 28.30.04) Staff Response: This condition has been met. The extension of Timberwolf Parkway and dedication as public right-of-way way will occur concurrently with subsequent development on Lot 3 in compliance with Kalispell's Subdivision Regulations. A note to this effect has been placed on the final plat. Note: West Reserve Drive has been renamed to Reserve Place by the Montana Department of Transportation. 4. The 20' easement shown on the plat shall not be exclusive to other public utilities (i.e. water, sewer, or storm sewer) and shall not encumber the future extension of Timberwolf Parkway. (Kalispell Subdivision Regulations, Section 28.30.14) Staff Response: This condition has been met. The 20" utility easement that is granted across Lot 3 is not exclusive to utilities only and shall permit the future extension of Timberwolf Parkway. A note to this effect has been placed on the final plat. 5. The future centerline intersection of the extended Timberwolf Parkway shall be at the same location as Reserve Drive and Ranch Road. (Kalispell Subdivision Regulations, Section 28.3.14) Staff Response: This condition has been met. The alignment of Timberwolf Parkway will match the centerline of Ranch Road on the north side of Reserve Place (formerly known as West Reserve Drive). A note to this effect has been placed on the final plat. Prior to final plat: 6. Right-of-way shall be granted to the city for the entire 60-foot road and utility easement (Timberwolf Parkway). The exact easement location shall be reviewed and approved by the Kalispell Public Works department and shown on the final plat. (Finding of Fact, Section D) Staff Response: This condition has been met. The dedication language is on the final plat. The 60- foot road and utility easement between Lots 1 and 2 (Timberwolf Parkway) will be dedicated upon recording of the final plat. The location of the roadway and easement was reviewed and approved by Kalispell Public Works. See attached letter from Kalispell Public Works dated May 3, 2013. 7. Timberwolf Parkway shall be designed as a City of Kalispell local street in compliance with Kalispell Design and construction standards. (Findings of Fact, Section D) Staff Response: This condition has been met. The design of Timberwolf Parkway was reviewed and approved by the City of Kalispell Public Works Department to ensure it complies with the design and construction standards for a local street. 8. The intersection of Timberwolf Parkway and Reserve Loop shall be designed in accordance with the recommendations contained in the Traffic Impact Study for the Bright View subdivision. The final traffic circulation design shall be reviewed and approved by the Kalispell Public Works Department. (Abelin Traffic Services, February 2013) Staff Response: This condition has been met. The intersection of Timberwolf Parkway and Reserve Loop has been designed in accordance with the recommendation in the Abelin Traffic Services' Traffic Impact Study for the Bright View Subdivision. The design was reviewed and approved by both Kalispell Public Works and the Montana State Department of Transportation. See attached MDOT Approach Permit from James Freyholtz, P.E. dated October 25, 2013. 9. The developer shall submit to the Kalispell Public Works Department for review and approval a stormwater report and an engineered drainage plan that meets the requirements of the current city standards for design and construction. Prior to final plat, a certification shall be submitted to the public works department stating that the drainage plan for the subdivision has been installed as designed and approved. (Kalispell Design and Construction Standards) Staff Response: This condition has been met. The drainage plan for the subdivision was reviewed and approved by the Kalispell Public Works Department. The developer's engineer has submitted a letter certifying that the stormwater drainage system and detention facilities were constructed and installed in accordance with the approved plans. See attached letter from CTA Architects -Engineers dated April 17, 2014. 10. The developer shall submit to the Kalispell Public Works Department prior to construction an erosion/sediment control plan for review and approval and a copy of all documents submitted to Montana Department of Environmental Quality for the General Permit for Stormwater Discharge Associated with Construction Activities. (Kalispell Design and Construction Standards) Staff Response: This condition has been met. The developer applied for and obtained a stormwater discharge permit for construction activities. See the attached Notice of Intent for permit coverage confirmation letter from with the Department of Environmental Quality dated April 25, 2013. 11. A letter from the Kalispell Public Works Department shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for unfinished work. (Kalispell Design and Construction Standards) Staff Response: This condition has been met. The Kalispell Public Works has accepted the new public infrastructure that has been installed. See attached letter from Kalispell Public Work dated April 28, 2014. 12. All existing and proposed easements shall be indicated on the face of the final plat. Utility easements for city water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating that the required easements are being shown on the final plat. (Kalispell Subdivision Regulations, Section 3.18) Staff Response: This condition has been met. All of the necessary utility easements are shown on the final plat. See attached email correspondence from Mark Crowley, Kalispell Public Works dated April 17, 2014. 13. The following statement shall appear on the final plat: "The undersigned hereby grants unto each and every person, firm or corporation, whether public or private, providing or offering to provide telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the right to the joint use of an easement for the construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and across each area designated on this plat as "Utility Easement" to have and to hold forever." Developer's Signature (Kalispell Subdivision Regulations, Section 3.18(E)) Staff Response: This condition has been met. The statement of above is included on the final plat and has been signed by the Director of the Montana Department of Natural Resources. On -going conditions: 14. All utilities shall be installed underground. (Kalispell Subdivision Regulations, Section 3.17) Staff Response: This condition has been met. All of the utilities to serve the subdivision have been installed underground. A note to this effect is on the final plat. 15. All areas disturbed during development shall be re -vegetated with a weed -free mix immediately after development. Staff Response: This condition has been met. The limits of disturbance for this subdivision include the area on Lot #1 for the Glacier Eye Clinic, which will be completely landscaped in accordance with a plan reviewed and approved by the Kalispell Parks Department. The disturbed areas on Lot #3 where the underground utilities were installed have been restored with a weed -free seed mix. A note to this effect is on the final plat. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in substantial compliance with the preliminary plat which was approved by the Kalispell City Council on September 3, 2013 COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance and the R- 5/PUD zoning designation for the property which governs the dimensional requirements of the lots within the subdivision as well as the uses. RECOMMENDATION: It can be found that the conditions of preliminary plat approval have been met or are otherwise adequately addressed. The staff recommends that the Kalispell City Council approve the final plat for Bright View Subdivision Phase 1. Please schedule this matter for the regular city council meeting of May 5, 2014. A storm water report for work completed associated with the finished work has been submitted, reviewed and approved by the City of Kalispell during the Glacier Eye Clinic Building Permit process. The developer shall submit to the Kalispell Public Works Department prior to construction an erosion/sediment control plan for review and approval and a copy of all documents submitted to Montana Department of Environmental Quality for the General Permit for Stormwater Discharge Associated with Construction Activities. An erosion/sediment control plan has been submitted and approved by the City of Kalispell as the time of the Glacier Eye Clinic Building Permit process. Any future development will issue a new erosion/sediment control plan prior to construction. The developer will submit an erosion control plan and obtain the City of Kalispell Stormwater Management permit and the Montana DEQ Stormwater Discharge with Construction Activities permit meeting the Montana Pollution Discharge Elimination System regulations. In accepting this permit the Permittee, its/his successors or assigns, agree to protect the State and save it harmless from all claims, actions or damage of every kind and description which may accrue to, or be suffered by, any person or persons, corporations or property by reason of the performance of any such work, character of materials used, or manner of installations, maintenance and operation, or by the improper occupancy of said highway right of way, and in case any suit or action is brought against the State and arising out of, or by reason of, any of the above causes, the Permittee, its/his successors or assigns, will upon notice to it/him of the commencement of such action, defend the same at its/his sole cost and expense and satisfy any judgment which may be rendered against the State in any such suit or action. 7) PROTECTION OF TRAFFIC. Insofar as the interests ofthe State and the travelling public are concerned, all work performed under this permit shall be done under the supervision of the District Administrator of the Department of Transportation and his authorized representatives, and he/they shall indicate barriers to be erected, the lighting thereof at night, placing of flagmen and watchmen, manner in which traffic is to be handled, and shall specify to Permittee how road surface is to be replaced if it is disturbed during operations, but said supervision shall in no way operate to relieve or discharge Permittee from any of the obligations assumed by acceptance of this permit, and especially those set forth under Section 6 thereof. B) HIGHWAY DRAINAGE. If the work done under this permit interferes in anyway with the drainage of the State Highway affected, Permittee shall, at its/his own expense, make such provisions as the State may direct to take care of said drainage. 9) RUBBISH AND DEBRIS. Upon completion of work contemplated under this permit, all rubbish and debris shall be immediately removed and the roadway and the roadside left in a neat and presentable condition satisfactory to the State. 10) WORK TO BE SUPERVISED BY STATE. All work contemplated under this permit shall be done under the supervision of and to the satisfaction of the authorized representative of the State, and the State hereby reserves the right to order the change of location or removal of any structure or installation authorized by this permit at any time, said changes or removal to be made at the sole expense of the permittee. 11) STATE'S RIGHT NOTTO BE INTERFERED WITH.
