The property is located at 106 51h Ave W, at the southwest corner of 5th Ave W and 1 st Street W, and within the RA-2 (Residential Apartment/Office) zoning district. In accordance with the City of Kalispell Zoning Ordinance, a Conditional Use Permit is required to operate a Homeless Shelter within the RA-2 zone. The property contains a dilapidated single-family structure that the owner plans to demolish in order to construct the new shelter. The new shelter will provide temporary housing for up to fifteen (15) residents for several weeks to as long as a year. The shelter will have two to three staff persons, with at least one person on -duty at all times. Staff recommended approval of the Conditional Use Permit, subject to seven (7) conditions. A neighbor to the subject property spoke to the planning board and expressed some reservations about the proposal and the operation of an adjacent thrift store that is operated by the applicant, A Ray of Hope. Two Ray of Hope board members also addressed the Planning Board to explain some details about the shelter operation and to respond to some of the neighbor's comments. The Planning Board voted unanimously (6-0) to forward a positive recommendation to the City Council, with a single amendment to the conditions. RECOMMENDATION: A motion to approve the Conditional Use Permit, along with the amended conditions of approval FISCAL EFFECTS: Approval of the request would have minimal fiscal impact to the City. The location of this district depends on proximity to major streets, arterials, and business districts. The growth policy anticipates a variety of uses under the Urban Mixed Use designation including, but not limited to, "multi -family, offices and other compatible uses as a transition tool with sensitivity to compatible design." EVALUATION OF THE REQUEST This application has been reviewed in accordance with the conditional use review criteria in the Kalispell Zoning Ordinance. A Conditional Use Permit may be granted only if the proposal, as submitted, conforms to all of the following general Conditional Use Permit Criteria, as well as to all other applicable criteria that may be requested: 1. Site Suitability: a. Adequate Useable Space: The property is level and measures 50 feet across and 142 feet deep, for a total area of 7,100 square feet. The property has adequate space for the construction of a homeless shelter that can meet the applicable zoning standards for building setbacks, building height, and lot coverage. b. Heiaht, bulk and location of the building: The existing building on the property is planned to be demolished. The proposed shelter will measure approximately 54 feet deep and 30 feet wide, at its longest dimensions. Approximate building heights have not been calculated, but the proposed structure is intended to be two stories above grade with a full basement. The structure will be required to receive Architectural Review Committee approval prior to review and issuance of the required building permit C. Adequate Access: The building will have its front on 5th Avenue West, with vehicular access to the property off ofthe paved alley. The paved alley connects with I" Street West and 2°d Street West. There is a sidewalk along the 5th Avenue West frontage, but no sidewalk along the 1st Street West frontage. d. Environmental Constraints: There are no known environmental constraints, such as steep slopes, streams, floodplains, or wetlands, on the property which could affect the proposed use. 2. Appropriate Design: a. Parking Scheme/Loading: The applicant is proposing the development of 5 parking spaces within a paved parking area in the rear of the proposed structure. There is additional parking at the Hope Thrift store located west of the property, across the alley, in the event the provided parking spaces are full. b. Lighting_ Section 27.26.030 of the Kalispell Zoning Ordinance sets standards for all outdoor lighting on commercial or residential structures. Exterior lighting installed in conjunction with the proposed use will be reviewed for compliance with the zoning ordinance. C. Traffic Circulation: The existing access is sufficient vehicular access to and from the property. d. Open Space: Specific open space is not required for this use in this zone, but the majority of the lot excluding the building is occupied with landscaping. e. Fencing/Screening/Landscaping: With the exception of the structure and the parking, the balance of the property will be landscaped with grass and shrubs. The landscape plan will be reviewed and approved prior to the issuance of the building permit. The landscaping will be installed prior to the issuance of the certificate of occupancy for the building. f. Signaae: Chapter 27.22 of the Kalispell Zoning Ordinance sets standards for the installation of signage in the city. The applicant is planning to place one sign in the front of the structure to identify it as a "Ray of Hope" shelter. The specific placement and size of the signage will be reviewed for conformance with these regulations. 3. Availability of Public Services/Facilities: a. Schools: This site is within the boundaries of School District #5. No impact is anticipated with the proposed use, as many of the residents of the shelter will already be from within the Kalispell School District. b. Parks and Recreation: There should be no significant increase in demand on the parks and recreation programs and facilities as a result of this use. C. Police: Police protection will be provided by the Kalispell Police Department. No unusual impacts or needs are anticipated from the proposed use. 4 d. Fire Protection: Fire protection will continue to be provided by the Kalispell Fire Department. The impact of the proposed change in this regard is minimal. e. Water: City water currently serves the property. No change in the impact on water services can be anticipated as a result of this use. f. Sewer: Sewer service is currently provided by the city. No change in the impact on water services can be anticipated as a result of this use. g. Storm Water Drainage: The site has an existing building and its parking lot is located on an adjacent property. No change is anticipated related to the proposed change. h. Solid Waste: Solid waste pick-up is provided by the city. The project will generate additional solid waste as compared to the vacant residential house on the property. Public Works has stated that the increased usage will have no impact on the provision of services. If necessary a larger waste receptacle will be placed in the alley for the increased usage. i. Streets: The primary street frontages are 5th Avenue West and 1st Street West. Access onto the property is off of the paved alley on the west side of the property. The alley is in good condition and will be unaffected by the proposed use. j. Sidewalks: There is a sidewalk along the 5th Avenue West frontage, but no sidewalk along the 1st Street West frontage. 4. Neighborhood impacts: The site is located just south of the boundary of a general business zoning district that contains a large variety of business types. It is not anticipated to have any impact on the neighborhood to the north. There are a number of mitigating factors that will ensure the proposed homeless shelter does not impact the neighborhood to the south. The first is that the proposed shelter is designed to look like a single-family home in the neighborhood, which will be an improvement over the dilapidated structure currently on the property. The next is that the applicant intends to install a sidewalk and landscaped planter strip along 1st Street West, which will complement streetscape environment and improve pedestrian access in the neighborhood. The next is that 5th Avenue West is a minor arterial, which sees nearly 4,000 average annual daily trips. Provided there is no vehicular access onto the property from 5th Avenue West, the use of the property for the requested conditional use should have negligible impact on the roadway and the neighborhood it serves. Finally, the neighborhood has become accustomed to the use based on the long-standing existence of the Ray of Hope shelter and thrift store in close proximity to the property. The addition of the new use on this property will augment these uses and keep them contained to the area on both sides of 1st Street West, west of 5th Avenue West. 5. Consideration of historical use patterns and recent changes: This area has historically included multi -family and single-family residences to the south and commercial business to the north. The recent history has seen the conversion of owner -occupied single-family homes into rental homes, as well as the conversion of single-family homes into multi -family dwellings. 5 6. Effects on property values: No significant negative impacts on property values are anticipated as a result of the requested conditional use of the property. C. RECOMMENDATION The staff recommends that the planning board adopt staff report #KCU-14-01 as findings of fact and recommend to the Kalispell City Council that the Conditional Use Permit be approved subject to the following conditions: D. We have no real objections to the permit. My tenants tell me that the proximity to the presnt Ray of Hope shelter and thrift store has not been a problem. They did ask for a privacy fence, because of the increased activity next door and the number of childern. Presently there is only a four -foot -high wire fence between the properties. I would like to point out that the current building at 106 Fifth Avenue West, the Busey House, is on the National Register of Historic Places. http://mhs.mt.gov/shpo/register/NRmap/NRbyCo/FH.xls It is the twin of our house, the Alexander House. The Busey House has foundation issues, and I understand why it is not usable in its present condition. But rather than tear it down, the new owners might offer it to someone who would move it. There may be more vehicle traffic than for a single family resident. We have designed off street parking that is accessed from the alley. We are told most homeless people do not have vehicles, so probably most of the traffic will be pedestrian. We have not proposed any traffic control beyond having the parking lot. b. The access to the property is from the alley on the west side, and from 5t' Avenue West on the east side, and from I" Street on the north side. There are 5 parking spaces on the proposed site. Residents can circulate around the property either on the lawn or on the sidewalks. c. There are 5 off street parking spaces including 1 van accessible space. d. There is an area adjacent to the parking spaces for dumpsters. e. The utilities are already in place due to the former single family residence being there. The power may have to be updated for increased load. f. There are trees and maybe a hedge in place from the former residence. If not a hedge is planned between on the south side of the property. g. One sign will be placed in the front yard. The remaining yard not used by parking spaces will be planted in grass and landscaping. h. The structure is 2 stories. The footprint area of the structure is about 1344 square feet. The lot is 50' x 142' which is 7100 square feet. The house covers 19% of the lot. We have tried to make the design of the structure be similar in style to the other houses in the immediate area. i. The open spaces are on all sides of the structure. What is not used for parking spaces. and walks will be planted in grass and other landscaping. j . The shelter is open 24 hours, 7 days per week. At least one staff member is there full time. Other staff have day -time hours. k. Nothing is being produced on the proposed site other than meals for the residents. There should not be any noise, dust, fumes or vibrations from the shelter activities. There may be odors emanating from the kitchen from food being prepared. The only out -door lighting will be at entrances and in the parking lot. We intend to use dark sky lighting. 4. Being a shelter, there will be various people outside in the yard.
