Resolution 5665 - AMENDS RESOLUTION 5248 - Preliminary Plat Northland Subdivision Phase 4A RESOLUTION AMENDING RESOLUTION NO.. 5248 THAT CONDITIONALLY
APPROVED THE PRELIMINARY PLAT OF NORTHLAND SUBDIVISION PHASE 4,
MORE PARTICULARLY DESCRIBED AS A 5.8 ACRE PORTION OF ASSESSOR'S
TRACT I LOCATED IN SECTION 1, TOWNSHIP 28 NORTH, RANGE 22 WEST, P.M.M.,
FLATHEAD COUNTY, MONTANA.
WHEREAS, Bridgeland Development, LLP, the owner of the certain real property described
above petitioned for approval of the Subdivision Plat of said property; and
WHEREAS, on the 5thday of November 2007, the Kalispell City Council passed Resolution No.
5248 that conditionally approved the preliminary plat for said property known as
Northland Subdivision, Phase 4; and
WHEREAS, Condition No. 6 of the approved preliminary plat included, among other things that,
"Summit Ridge Drive shall be gated at Northland Drive for emergency access onlyl
and
WHEREAS, Bridgeland Development, LLP has complied with all conditions of the preliminary
plat, including all of Condition No. 6 set forth above, and now is seeking to receive
final plat from the City; and
WHEREAS, from the time that Summit Ridge Drive has been gated at Northland Drive the
Kalispell City Council and City Staff have received concerned inquiries and
complaints from motorists and neighboring property owners about the public safety
and traffic design purposes of the gated roadway' as well as concern from some
neighboring property owners that the gate remain to stem the flow of through traffic;

WHEREAS, the Kalispell City Council therefore requested that the matter be brought back before
the Council regarding the concerns that the public has expressed about the gated
roadway so that it may be reconsidered; and
WHEREAS, upon review of the City's policies for public safety, roadway maintenance and traffic
design the Council finds that this blocked roadway places constraints on public safety
responses from police and fire, creates unreasonable constraints on the public works
department in its efforts to maintain the passability of the roadway and fails to follow
the City policy of designing and maintaining its streets to provide connectivity for
more efficient traffic flow; and
WHEREAS, the City Council of the City of Kalispell hereby finds, upon consideration of the
City's policies, as well as all concerns expressed from the public, that it is in the best
interests of the City, the property owners and the motoring traffic that the gate be
_permanently removed from Summit Ridge Drive at Northland Drive.
NOW THEREFORE., BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION 1. That portion of Condition No. 6 in the preliminary plat of Northlands
Subdivision Phase 4 enacted by Resolution No. 5248 that states, "Summit
Ridge Drive shall be gated at Northland Drive for emergency access only"
shall be and is hereby stricken from the condition.
SECTION 11. City staff is directed to permanently remove the gate that obstructs Summit
Ridge Drive at Northland Drive and to maintain this roadway as open to the
public.
SECTION 111.Upon proper review and filimr of the Final Plat of said subdivision in the
office of the Flathead County Clerk and Recorder, said premises shall be a
subdivision of the City of Kalispell.
