I have contacted Chad at Parks and Howard Mann, of Silverbrook. We all concur that all the required improvements
have been completed and the joint account has been closed. Please remove the Silverbrook Estates Subdivision
Improvements Agreement from the City's SIA/Bond list. See attached letter from Howard Mann.

Thanks for getting back to me so promptly Howard. As I mentioned on the telephone yesterday, I'm trying to
clean up some internal documents related to City held performance bonds. One item on the list is the joint bank
account that guaranteed the completion of the improvements required at Silverbrook Estates. In order to clear
this from our list, I need some correspondence from you that indicates: The work is complete; and the warranty
period is also closed and there are no items to address.
If you could simply reply and concur, I will be able to direct the Finance Dept to remove the item from the list.

Dear Howard:
This letter is to serve as acceptance for account number 10303916 at Glacier Bank to serve as
the security to extend the completion date for conditions 20, 21 and 22 for final plat of
Silverbrook Estates Phase 1 A.
This account and balance ($100,000.00) is to remain in effect till a -final inspection and sign off
by the Kalispell Parks and Recreation Department is made. You will need to notify our
department when these items are completed. If these, items are not completed in 120 days,
Kalispell Parks and Recreation will contract for these items and use account number 10303916
from Glacier Bank to pay for the completion.
As a reminder: tree plantings are required to meet ISA standards for planting and the Street
Tree Ordinance standards of 2 W caliper and of an approved species from the Kalispell Parks
department planting list. Boulevards are to be seeded or sodded to meet Parks Department
and city standards. Final approval will be given upon completion, inspection and approval of the
landscaping and tree plantings at which time bonding and/or letter of credit would be released.
It should be noted that the trees and landscaping are under a warranty 2 year period and should
they die within this time frame, the developer will be responsible for replacement.

Glacier Bank of Whitefish has established a deposit account in the amount of four million
dollars (4,000,000) to fund improvements to -phase one of a new subdivision known as
Silverbrook Estates located at U.S. Highway 93 North, Kalispell, Montana. This account
will be restricted for the purpose of disbursing funds based on work completed as
outlined in Subdivision Improvement Agreement dated February 19, 2008. We will
disperse funds through draw requests mutually agreed upon by Developer and the City of
