Ordinance 360 - Licensing Soft Drink Establishments, Pool Rooms, EtcI ORDINANCE NO. 360, AN ORDINANCE LICENSING AND REGULATING SOFT DRINK ESTABLISIM13NTS 31 POOL ROOITS, ROOMING HOUSES AND RESTAURANTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL: Section 1. No soft drink establishment, pool room, rooming house, or restaurant shall be conducted or maintained in the city of Kalispell unless the person or persons conducting or maintaining the sa- me have'a license for that puripose issued under the provisions of this Ordinance and in full force and effect. Section 2. The City -Treasurer is 'required and directed to issue a license for any of the purposes hereinbefore specified only opon written application approved by the -Mayor or if not so approved, by order of the City Council as*hereinafter-provided. Section 3. Before the city Treasurer shall issue any such license he shall require the applicant to pay the following fee; For a soft drink parlor or pool room or for both when conducted in the same place of business the sum of five dollars per quarter', and for rooming houses _2_1( or restaurants the sum of two dollars per quarter. Section,4. The Mayor may refuse to approve any application for a license under the provisions of this Ordinance when in his judgment the person applying for such license will not conduct the Particular business for which the license is applied for in an orderly or lawful manner, and the Mayor may, by order filed with the City Clerk, revoke any license issued under the provisions of this Ordinance when the business for which such license was issued is not conducted, in his judgment, in an orderly or lawful manner. Section 5. Whenever the Mayor shall refuse to approve an applicat- ion for a license under the provisions of this Ordinance or shall revoke a license which has been issued under the provisions hereof, he shall at the next regular meeting of the City Council report such action to the City Council and the City Council may, in the case of the refusal to app- rove an application for a license, by two-thirds vote of all the members thereof elected, order the City Treasurer to issue such license without the approval of the Mayor. The City Council may by a like vote also re- store and revive any license which has been revoked by the Mayor. Section 6. No license issued under the provisions of this Ordi- nance shall be transferred without the approval of the Mayor, or in the cars of his refusal to approve, by a vote of the City Council by a two- thirds vote of all the members elected to the Council. Section 7. The term roominghouse as used in this Ordinance is de- fined as being any building, not a hotel, in which five or more rooms are let for hire. Section 8. The provisions of all Ordinances in conflict with this Ordinance are hereby repealed. Section 9. This Ordinance shall take effect thirty days after its passage and approval.
