Ordinance 346 - Regulating Public SpeakingORDINANCE No. 346
AN ORDINANCE Regulating public speaking in certain cases dur-
ing the continuance of the war in which the United States is now
engaged, and declaring an emergency.
BE IT ORDAINED By the Council of the City of Kalispell-.
Section a. Any person who shall, during the continuance of
the war in which the United States is now engaged, except in one
of the established schools or churches of the City or under the
auspices of one of the waractivities, make -a public speech or de-
liver a public lecture in the City of Kalispell without a permit
in writing from the 111qyor of the City in full torce and effect
shall be, guilty of the offense of unlawful public spetkIng and upon
conviction thereof shall be punished by a fine of not exceeding
three hundred dollars or by imprisonment of not exceeding ninety
days or by both such fine and imprisonment,
Section 2. Any permit issued by the 1ayor under the pro-
visions of section one of this ordinance may be revoked, by him
when ever in his judgement it would be best :cor the public safety
so to do.
Section 3. Any action of the Mayor in refusing or revoking
a permit under the provisions of this ordinance may be set aside
by the Council by a two thirds vote and a permit issued by the
Council by a two thirds vote, which permit so issued by the Council

shall have tne same force and effect as a permit issued by The Mayor
until revoked by The Council by a majority vote.
Section 4- This ordinance shall not be construed to apply

to cases covered by Ordinance No. 344 of the City of Kalispell, en-
titled; "AN ORDINANCE Regulating speaking on the avenues, streets,
alleys, parks, public ways and public grounds of the City of Kalis-
pell and declaring an emergency." Passed and approved September 3rd
1917, nor shall it be construed as repealing or amending such ordi-
nance or any of the provisions thereof,
Section This ordinance is declared to be an emergency
measure and its going into immediate effect necessary ror the pres-
ervation of safety.
Section 6. The provisions of all ordinances in conflict'viith
this ordinance are hereby repealed.
Section 7. This ordinance shall take effect upon its passage
