Ordinance 344 - Regulating Speaking on Streets, Etc w/o PermitOrdinance No. 344 I AN ORDIE"AITCE regulating speaking on the avenues, streets, alleys, parks, public ways and public grounds of the City of Kal- ispell and declaring an emergency. BE IT ORDAINED by the Council of the City of Kalispell: Section 1. Any person who shall in the City of Kalis- pell deliver sn address, or lecture, or make a speech, or cause a crowd to gather for the purpose of hearing an address, lecture or speech, or. any avenue, street alley, park, public way or public grounds of the City of Kalispell, without first having made a written U application to and obtained a permit in writing therefor from the Y, Hyor or Council, or who shall print, publish, advertise, or distribute or circulate any advertisement of any such address, lecture, speech or assemblage in any case where the permit herein provided for has not been granted, sha.11 be guilty of the offense of inciting an unlawful assembly and upon convict- ion thereof shall be punished by a fine of not exceeding three hundred dollars or by imprisonment of not exceeding ninety days or by both such fine and imprisonment. Section 2. The application herein provided for shall state the particular place where the speaking is to take place, the name of the speaker, his age, his citizenship, his permanent residence, whether he is a resident of the City of Kalispell and if so how long he has been such a resident, his occupation, the subject to be discussed, the date and hour of the speaking,* whether or not he represents or is in the employ of any organ- ization and if so the name of such organization, shall. be signed and verified by the speaker or some one in his behalf and shall have endorsed upon it the approval or dis approval of the Chief of Police of the City of Kalispell, Section 3. The 419yor or Council may refuse to grant the permit herein provided for whenever --7- in his or their judgment as the case may be it would be best ior the public safety so to do. Section 4. This ordinance is declared to be an em- ergency measure and its going into immediate effect necessary for the preservation of safety. Section 15. The provisions of ail ordinances in conflict with this ordinance are hereby repealed. S,ection 6. This ordinance shall take ei'iect upon its passage and approval.
