ORDINANCE NO. 339
AN ORDINANCE PROVIDING FOR THE CLOSING UNDER CERTAIN CONDITIONS
OF SALOONS AND OTHER PLACES WHERE INTOXICATING LIQUORS ARE SOLD.
BE IT ORDAINED By the City Council of the City of Kalispell:
Section 1. The Mayor of the City of Kalispell is here
by authorized and empowered, by proclamation, to close any and
all saloons and other places where intoxicating liquors are sold,
in the City of K-4lispell, for a period of not to exceed forty
eight hours, whenever in his judgement such action is necessary
for the preservation of peace and safety.
Section 2. The City Council may, by resolurion duly ad-
opted and entered upon the minutes of the Council, close any and
all saloons and other places where intoxicating liquors are sold,
in the City of Kalispell, for such period of time as it may de-
termine, whenever it may consider such action necessary for the
preservation of peace and safety.
Section 3. Any person who shall keep open any saloon or
other place where intoxicating liquors are sold, in the City of
Kalispell, at any time such saloon or other place where intox-
icating liquor&are sold is directed to be closed by the Mayor
or by the City Counci-1,-as herein provided, shall thereby commit
the offense of keeping a saloon open unlawfully, and upon con-
viction thereof, shall be punishei by a line of not exceeding
three hundred dollars, �or by impris,onment of not exceeding thirty
days, or by both such fine and imprisonment.
Section 4. This Ordinance is hereby declared to be an
Emergency Measure, and its going into immediate effect necessary
for the preservation of the public peace and safety.
Section 5. The provisions of all ordinances in conflict
with this ordinance are hereby repealed.
Section 6. This Ordinonce shall take immediate eff°e'c,t
passage and approval.
