Ordinance 324 - Creates City Board of Healthmq� 0 R D I NAN C E NO. 324. AN ORDINANCE TO AMEND SECTIONS 276, 277, 278, 279 and 280 OF ORDINANCE NO. 231.1 entitled "An Ordinance Revising, codifying and enacting the General Ordinances of the City of Kalispell, and -repealing all Ordinances.or parts of Ordinances in conflict therewith," approved July 24th, 191-1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL: Section 1. Section 276 of Ordinance No. 231, entitled, "An -Ordinance revising, codifying and enacting the General Ordinances.of the City of Kalispell, and re- pealing all Ordinances or parts of Ordinances in conflict therewith", approved July 24th, 1911, is amended to read as follows: Section 276. A Board of Health of the City of Kalispell is hereby cz,eitlled which shall consist of three members. Section 2. Section 277 of Ordinance No. 231, entitled, "An Ordinance revising, codifying and enacting the General'Ordinances of the City of Kalispell, and re pealing all Ordinances or parts of Ordinances in conflict therewith", approved July 24th, 1911, is amended to read as follows: Section 277. The Mayor shall be a member of the Board of Health and one of the members shall be an alderman of the City and one axegularly licensed and practicing physician residing within the City of Kalis- pell, which members other than the Mayor shall be appoint- ed by the Mayor with the consent of the Council. The members of the Board of Health shall hold their offices for one year and until their successors are appointed and qualified. Each member of the Board of Health shall take the oath of office required of other City officers. The Board of Health shall have the power to make by-laws and M regulations for its own Government and to'issue such orders as maybe necessary for.,the proper performance of the duties of the Board not inconsistent with the Laws of the State or the ordinances of the City of Kalispell. The Board of Health shall keep a record of its official proceedings, which shall be open to the inspection of any citizen of the City at any reasonable hour. Section 3. Section 278 of Ordinance No. 231- entitled, "An Ordinance revising, codifying and enacting the General Ordinan.ces of the City of Kalispell, and re- pealing all Ordinances of parts of.Ordinances in conflict therewith", approved July 24th, 19.11, is maended to read as follows: Section 278. The physician member of the Board of Health shall be ex-officio the Health Officer of the -A City and as such shall be gove'rned by and execute the ord- ers of the Board of Health. Section 4.. Section.279 of Ordinance No. 231, entitled "An Ordinance revising, codifying and enacting the General Ordinances of the City of Kalispell, and re- pealing all Ordinances or parts of Ordinances in conflict therewith", approved July 24th, 1911, is amended to read as follows: ,Section 279. The members of the said Board of Health shall serve without compensation with the excep- tion of the Health Officer who shall receive as compensa- tion a salary to be fixed from time to time by the City Council. The Board of Health shall have general super- vision of the sanitary conditions of the City; shall have power to declare what are nuisances liable to impair 00 the general health of the people; to direct the Health Officer to abate the same. $ also to place in quarantine persons, houses or districts infected with or by infect- ious or contagious diseases and to require the Health Officer to execute the orders of the Board in such cases. Section 5. Section 280 of Ordinance No. 231, entitled "An Ordinance revising, codifying and. enacting the general Ordinances of the City of Kalispell, and re- pealing a.11 Ordinances or parts of Ordinances in conflict therewith".. approved July 24th, 1911, is amended to read as follows: Section 280. The Chief of Police and all the members of the Police force, shall, whenever called upon by the Board of Health or the City Health Officer, assist in enforcing the orders of the Board of Health. Section 6. This Ordinance is hereby declared to be an Emergency Measure and its going Into immediate effect necessary for the preservation of the public health. Section 7. The provisions of all. ordinances in conflict with this Ordinance are hereby repealed. Section 8. This Ordinance shall take immediate effect upon its passage and approval.
