ORDINANCE NO. 3_a
An Ordinance defining the keeping or maintaining of places where
intoxicating liquors are sold, furnished, or given away in violation
of law, or the illegal sale.or solicitation for illegal sale of
intoxicating liquors in an open, notorious, and public manner, or the
illegal transportation thereof with intent to effect a sale, in an open,
notorious, and public manner, to be common nuisances, providing penal-
ties for violation of this nrdirance and a method of abatement, and
repealing Section 385 of.tne-tevised_Ordinances of-1922.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
Section 1. The keeping or maintaining of a place where intox-
icating liquors are sold, furnished, or given away in violation of the
law, state or national, is hereby declared to be a common nuisance,
also the sale or solicitation for Bale of intoxicating liquors in an
open, notorious, and public manner, contrary to law, state or national,
or the transportation of intoxicating liquor with intent to effect a
sale, in an open, notorious and public manner, contrary to law, state
or national, are hereby declared to be common nuie�ces.
Section 2. Every person who violates this 0 dsngnce shall be
guilty of a misdemeanor, and upon conviction thereof shall be fined
not less than $50.00 nor more than 0300.00; provided, that if the fine
be not paid the person convicted shall be imprisoned in the city or
county jail one day for each and every $2.00 of such fine.
Section 3. For the purpose of thi`e0'iAinance the words "intox-
icating liquor" shall be construed to mean any or all liquids fit for
use for beverag e., purposes which shall contain one-half of one per
oentum or more of alcohol by volume.
Section 4. An violation of this"Ordinance Ordinance may be abated in the
same manner as other nuisances are abated, and by the method as is
provided by Ordnance of this City.
Section 5. Section numbered 395 of the Revised Ordinances of
the City of Kalispell of 1522, being Ordinance numbered 366, entitled
"An Ordinance revising, codifying and re-enacting the general ordin-
ances of the City of Kalispell , and repealing all Ordinances or parts
of Ordinances inconfliot therewith" and all Ordinances and parts of
Ordinances in conflict herewith are hereby repealed.

Section 6. This Ordinance shall be in full force and effect
thirty days after its adoption and approval.
