MF:NT OF THE CITY OF KALISPELL, MONTANA.
WHi REAS, Chapter 200 of the Session Laws of the 25th Legis-
lative Assembly of the State of Montana provides a minimum com-
pensation for members of paid Fire Departments of cities of the
second class, and imposes a penalty for a violation thereof, and
WHEREAS, said act prevents the city from using the services
of any fireman unless he is paid the compensation provided for
herein, and by reason thereof it is necessary to repeal the Sec-
tions of the ordinances of the City of Kalispell, relating to
what is known as the Volunteer Fire Department and enacting an
ordaince to conform to the restrictions and limitati_)ns imposed
by the laws of the State of Montana, relating to Fire Depart-
ments of cities of the second class, now, therefore,

3E IT ORDAINED BY THE COTIvCIL OF THE CITY OF KI'LISPELL, I,IONTAN A:
Section 1. That Sections 42 and 44 of the Revised Ordinances of
Kalispell, passed and approved P,Iarch 5th, 1928, be and the same
are hereby amended so as to read as follows:
Section 42-. The Fire Department of the City of Kalispell,
shall consist of not less than seven firemen, whose qualifications,
hours of service and compensation shall be governed by the laws
of the State of 'Montana, relating to Fire Departments of cities
and towns, now in force or which may hereafter be enacted. The r
Ialayor shall nominate, and with the consent of the Council, apUoint
the chief of the Fire Department, the assistant chief, and all
firemen.

Section 44. The Chief of the Fire Department shall have sole
command and control over all persons connected with the Fire
Department and shall possess full power and atithority over its

organization, government, and discipline, .an o is en may
from time to time establish such disciplinary rules and regula-
tions as he may deem advisable, subject to the approval of the
City Council; he shall have charge of and be responsible % r
the engines and other apparatus, the property the city furnished
the Fire Department, and see that they are at all times ready for
use in extinguishing of fires. The assistant chief, of the '_'ire
Department, shall aid the chief in the work of the department
and in his absence shall perform his duties.
Section 2. That Sections 43, 45, 46, 47, 48, 50, b3, b4, :)5, 57
and 58 of the Revised Ordinances passed and approved March 5,
1926, be and the same are hereby repealed.
Section 3. That the provisions of the Laws of the State of I:Iontana
relating to Fire Departments of cities and towns, and Firemen's
Disability Funds, the management thereof, and the power given to
the Mayor and City Council, relating therato, shall govern the
organization, management and control of the Fire Department and
the members thereof of the City of Kalispell.
