STTCH TTS S, AND PR?,SCRIBINIP PNIALTI?TS FOR 't ? VIOLATION OF THIS ORā¢INANCE. BE IT ORDAIN7,D BY TH7 COUNCIL 07 ` EiE CITY OF KALISP`ML: Section 1. The phrase "Public Ways" and "Public Places" used herein shall be construed to mean and include the streets, avenues, alleys, sidewalks and parks of the ©ity of Kalispell. The phrase "Conjested District" is defined by subdivision (b) of Section 247 of the 'Ievised Ordinances of Kalispell. Section 2, It shall be unlawful for any person, firm or cor por- ption to hereafter use or occupy any part of the public ways of the City for the following purposes, namely: The construction and use of vehicular driveways across sidewalks between business places and streets and avenues; the construction and use of stairways upon sidewalk space to basement and second floors of business buildings; for parking space for vehicles set apart by "No Parking" signs; for the erection and maintenance of telephone, telegraph and electric light poles; without obtaining a permit for such use from the City Council. The right is reserved to the Council to deny any application for a permit for the above uses. The City Gouncil by Resolution may order the discontinuance, abandonment or removal of any such uses on any pert of the public ways of the City, when it deems such use to be de- trimental to the safety and/or convenience of the public, or when such use is not conducive to the -best interests of the City. Section 3. Every person, firm or corporation occupying and/or using for commercial purposes, or as an aid or adjunct in the conduct of their business, any part of the public ways or public places of the City of Kalispell for any of the uses and purposes designated in paragraph two hereof, shall pea for such use and occupation an annual rental to the City of Kalispell as follows: Sidewalk crossings: For each eight linear feet or major fraction thereof the sum of -------- $3.00 For each stairway in sidewalk space leading to basement or upper floors of buildings, the sum of-5.00 For each reserved parkinT space in front of business houses for each twenty-five feet or major fraction thereof ---------------------------------- 12.00 For each electric light pole, excepting poles from which are suspended street lights and police signals, in conjested districts ------------------- 12.00 For each telephone pole in conjested districts---- 6.00 For each pole from which is suspended both electric lights and to -b phones within the conjested district------------------------------- 12.00 For each electric light pole outside of con - jested districts, except ink; poles from which are suspended street lights---------------------- 8.40 For each telephone pole outside of conjested districts---------------------------------------- 6,00 For each pole from which is suspended both electric lights and telephones, outside of conjested districts------------------------------ 8,40 For each telegraph pole-------------------------- 8.40 Section 4. All those required to ps y any rental under the provisions of this Ordinance, shall lay the same quarter -annually, in advance to the City Treasurer when the sum to be paid does not
