ORDINANCE NO.436. .
AN ORDINANCE DEFINING THE TERM "ITINERANT VENDOR" AND "PEDDLER"
AND PROVIDING FOR THE REGULATION AND LICENSING OF ITINERANT VENDORH
AND PEDDLERS,FIXING THE AMOUNT OF LICENSE FEES TO BE PAID AND TO
PROVIDE FOR THE ENFORCEMENT THEREOF,AND TO PROVIDE PENALTIES FOR
THE VIOLATION OF ANY OF THE TERMS OF SAID ORDINANCE AND FOR THE
PURPOSE OF REPEALING SECTION 606 OF THE REVISED ORDINANCES OF MONTANA
KNOWN AS ORDINANCE NUMBER 411 PASSED AND APPROVED MARCH 5,1928.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
Section 1. That any person engaged or employed in the business '
of retailing to consumer by going from consumer to consumer either
on the street or to their places of residence or employment and there
soliciting,selling and offering to sell or exhibiting for sale by
sample,catalogue or otherwise,any goods or merchandise of any nature
or description,shall within the meaning of this Act', -.be considered
an itinerant vendor or peddler;a consumer within the meaning of
this Aet,is one who uses and by using,destroys the value of the article
purchased. This act shall in no way effect any per6on,firm,co-partnership
or corporation with a commercial rating or who maintain a place of
business within the state of Montana.Provided this ordinance shall not
apply to farmers within Flathead County, Montana for produce raised in
said county.
Section 2. Any person or persons,co-partnershipor corporation
desiring to pursue the business of a peddler or itinerant vendor
shall first obtain a license therefor from the City Treasurer and
shall pay therefor the sum of $ 10.00 per quarter for such license to
conduct such business for the period of 90 days from the date when
such license was issued.
Section 3. Any person violating any of yhe provisions of this
Ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof, shall be fined a sum not less than $ 10.00 or more than $ 100.00.
Section 4. All Ordinances or parts of Ordinances in conflict I
with this Ordinance are hereby repealed.
Section 5. An urgency and emergency is hereby declared to,.
and does exist.
Section 6. This ordinance shall be in full force and effect
from and after its passage and approval.
Passed by the City Council of the City of Kallspell,Montana,
this 23rd. day of July,A.D.1931.
Approved by the Mayor of the City of Kalispell, Montana, this
